RESOLUTION NO.
A RESOLUTION GRANTING SPECIAL (CONDITIONAL USE) PERMIT
UNDER SECTIONS 14-113(7) AND 14-123.00(2) OF THE ST. LOUIS PARK
ORDINANCE CODE RELATING TO ZONING TO PERMIT FILL WITH
SOME BELOW THE 893.7 FOOT 100 YEAR FLOOD ELEVATION FOR
PROPERTY ZONED PUD, PLANNED UNIT DEVELOPMENT DISTRICT
LOCATED AT 7450 WALKER STREET AND 3280 LOUISIANA AVENUE
SOUTH
BE IT RESOLVED BY the City Council of the City of St. Louis Park:
Findings
1. The City of St. Louis Park, Division of Parks and Recreation has made application to
the City Council for a special permit under Sections 14-113(7) and 14-123.00(2) of the St.
Louis Park Ordinance Code for the purpose of allowing fill with some below the 893.7 100
year flood elevation within a PUD, Planned Unit Development District located at 7450
Walker Street and 3280 Louisiana Avenue South for the legal description as follows, to -wit:
Block 2 and Park 2 Oak Park Village
2. The City Council has considered the advice and recommendation of the Planning
Commission (Case No. 89 -51 -SP) and the effect of the proposed fill with some below the
893.7 foot 100 year flood elevation on the health, safety and welfare of the occupants of the
surrounding lands, existing and anticipated traffic conditions, the effect on values of
properties in the surrounding area, the effect of the use on the Comprehensive Plan, and
compliance with the intent of the Zoning Ordinance.
3. The Council has determined that the fill will not be detrimental to the health, safety,
or general welfare of the community nor will it cause serious traffic congestion nor hazards,
nor will it seriously depreciate surrounding property values, and the proposed fill is in
harmony with the general purpose and intent of the Zoning Ordinance and the
Comprehensive Plan.
4. The contents of Planning Case File 89 -51 -SP are hereby entered into and made part of
the public hearing record and the record of decision for this case.
Conclusion
The special permit to permit of fill with some below the 893.7 foot 100 year flood elevation
at the location described is granted based on the findings set forth above and subject to the
following conditions:
1. That prior to placement of the fill, a revised grading plan be submitted to and
approved by the City Forester a$id the Community Development Department which
will:
a. Limit the amount of runoff which is directed to the depression along the west
edge of the site to its current conchtion.
b. Limit the amount of overburden to a maximum of four inches in any given
area except that those low areas along the trails and within the soccer field
where water ponding occurs, enough fill may be placed to eliminate the
ponding.
2. That the Public Works Department certify that the fill is in accordance with the
approved grading plans.
3. That this Special Use Permit approval is contingent upon receiving all' required state
and federal permits and approvals including those required by the MPCA, EPA,
Minnehaha Creek Watershed District, and the Minnesota Department of Natural
Resources to ensure compliance with the Consent Decree and attached thereto, the
Remedial Action Plan entered into in September 1986, in connection with the Reilly
Tar & Chemical Corporation litigation.
4. That this Special Permit is effective upon resolution of the pending litigation
between the Economic Development Authority/City and Oakmont Partners.
5. That all improvements are completed within one year of resolution of the litigation
referenced in condition 4.
