RESOLUTION NO. 89-134
A RESOLUTION RESCINDING RESOLUTION NO. 87-94 ADOPTED
ON JULY 20, 1987, AND RESCINDING RESOLUTION NO. 86-142
ADOPTED ON SEPTEMBER 2, 1986, AND GRANTING SPECIAL
(CONDITIONAL USE) PERMIT UNDER SECTIONS 14-146(5) AND
14-146.1 OF THE ST. LOUIS PARK ORDINANCE CODE RELATING
TO ZONING TO ALLOW THE ADDITION OF THREE DWELLING
UNITS TO AN EXISTING 105 UNIT APARTMENT BUILDING AND A
COMMERCIAL PARKING LOT AT 4301 PARK GLEN ROAD
FINDINGS
WHEREAS, KK Corporation has made application to the City Council for a
special permit under Sections 14-146(5) and 14-146.1 of the St. Louis Park
Ordinance Code to allow the addition of three dwelling units to an existing 105
unit apartment and a commercial parking lot at 4301 Park Glen Road within a R-
B Residential Business District having the following legal description:
Lot 2, Block 1, Beltline Business Park, according to the recorded plat
thereof, and that part of Lot 3 said Block 1 described as follows:
Beginning at the most southwesterly corner of said Lot 3; thence on
an assumed bearing of North 20 degrees 01 minutes 20 seconds West
along a southwesterly line of said Lot 3 a distance of 219.35 feet to the
intersection with the south line of Park Glen Road as dedicated in
said Beltline Business Park; thence North 69 degrees 58 minutes 40
seconds East, along said south line 33.46 feet to a point of curvature
of a nontangential curve in said south line; thence southeasterly,
easterly and northeasterly, along the right-of-way line of said Park
Glen Road, 175.81 feet, along said nontangential curve, concave to the
northwest, having a radius of 60.00 feet and a central angle of 167
degrees 53 minutes 16 seconds, the chord of said curve bears North 51
degrees 24 minutes 34 seconds East; thence North 74 degrees 58
minutes 40 seconds East, not tangent to last described curve, 91.77
feet; thence northeasterly 183.78 feet along tangential curve, concave
to the south, having a radius of 1096.00 feet and a central angle of 09
degrees 36 minutes 27 seconds; thence North 84 degrees 35 minutes
07 seconds East, tangent to last described curve, 153.39 feet; thence
South 05 degrees 24 minutes 53 seconds East 136.04 feet to the
intersection with the south line of said Lot 3; thence westerly 535.21 '
feet along the south line of said Lot 3 to the point of the beginning.
WHEREAS, the City Council has considered the advice and recommendation of
the Planning Commission Case No. 89 -75 -SP and the effect of the proposed the
addition of three dwelling units to an existing 105 unit apartment and a
commercial parking lot on the health, safety, and welfare of the occupants of the
surrounding lands, existing and anticipated traffic conditions, the effect on
values of properties in the surrounding area and the effect of the use on the
Comprehensive Plan; and
WHEREAS, a special permit was issued regarding the subject property
pursuant to Resolution No. 87-94 of the St. Louis Park City Council dated July 20,
1987 which contained conditions applicable to said property; and
WHEREAS, due to changed circumstances, amendments to those conditions are
now necessary, requiring the amendment of that special permit; and
WHEREAS, it is the intent of this resolution to continue and restate the
conditions of the permit granted by Resolution No. 87-94 to add the amendments
now required, and to consolidate all conditions applicable to the subject property
in this resolution;
WHEREAS, the contents of Planning Commission Case File 89 -75 -SP are
hereby entered into and made part of the public hearing record and the record
of decision for this case.
CONCLUSION
NOW THEREFORE BE IT RESOLVED that Resolution No. 87-94 filed as
Document No. 5312131 is hereby rescinded and replaced by this resolution which
continues and amends a special permit to the subject property for the purposes
of permitting the addition of three dwelling units to an existing 105 unit
apartment and a commercial parking lot within the R -B, Residential Business
District at the location described above based on the following conditions:
1. That the site shall be developed, used and maintained in accordance with
Exhibit A - Site Plan; Exhibit B - Planting Plan, Grading and Site Utility
Plans amended by Exhibit B-1, As -Built Survey dated July 27, 1988; Exhibit
C - Garage Level Foundation Plan; Exhibit D - First Floor Plan; Exhibit E -
Second Floor Plan; Exhibit F - Third Floor Plan; Exhibit G - Exterior
Elevations, Sheet 7; and Exhibit H - Exterior Elevations, Sheet 8; subject to
the following conditions:
2. The front yard setback shall meet the minimum requirements of the zoning
ordinance.
3. All curbing shall be poured -in-place concrete measuring six inches above
and below grade.
4. There shall be no outdoor storage of trash or trash facilities.
5. All outdoor lighting other than globe lighting shall be directed
perpendicular to the ground and shall be no higher than 25 feet.
6. Private easements shall be granted over the abutting property to conduct
the storm waters to the public storm sewer system.
7. All improvements included building, landscaping and street trees, parking,
striping, curbing and completed open space in conditions 1-6, shall be
completed by October 15, 1988.
8. Exhibits D and E, First and Second Floor Plans are hereby modified by
permitting three additional dwelling units as shown on Exhibit I, First
Floor Plan Proposed Remodeling and Exhibit J, Second Floor Plan
Proposed Remodeling.
7. All improvements as stated in condition number 8 should be completed by
September 1, 1990.
