A RESOLUTION GRANTING SPECIAL (CONDITIONAL USE) PERMIT
UNDER SECTIONS 14-113(7) AND 14-123.00(2) OF THE ST. LOUIS PARK
ORDINANCE CODE RELATING TO ZONING TO PERMIT 6,000 CUBIC
YARDS OF FILL FOR PROPERTY ZONED PUD, PLANNED UNIT
DEVELOPMENT DISTRICT LOCATED AT 5005 WEST 36TH STREET
BE IT RESOLVED BY the City Council of the City of St. Louis Park:
Findings
1. The City of St. Louis Park, Division of Parks and Recreation has made application to
the City Council for a special permit under Sections 14-113(7) and 14-123.00 (2) of the St.
Louis Park Ordinance Code for the purpose of allowing 6,000 cubic yards of fill within a
PUD, Planned Unit Development District located at 5005 West 36th Street for the legal
description as follows, to -wit:
Blocks 4, 5, 6, 9, 10 and 11 also that part of Block 7 lying southerly of
Monterey Drive and Lots 1 to 6 inclusive Block 8 and Lots 8 to 14 inclusive
Block 8 except streets including vacated streets and alleys all in Westmoreland
Park
2. The City Council has considered the advice and recommendation of the Planning
Commission (Case No. 89 -51 -SP) and the effect of the proposed 6,000 cubic yards of fill on
the health, safety and welfare of the occupants of the surrounding lands, existing and
anticipated traffic conditions, the effect on values of properties in the surrounding area,
the effect of the use on the Comprehensive Plan, and compliance with the intent of the
Zoning Ordinance.
3. The Council has determined that the 6,000 cubic yards of fill will not be detrimental to
the health, safety, or general welfare of the community nor will it cause serious traffic
congestion nor hazards, nor will it seriously depreciate surrounding property values, and
the proposed 6,000 cubic yards of fill is in harmony with the general purpose and intent of
the Zoning Ordinance and the Comprehensive Plan.
4. The contents of Planning Case File 89 -51 -SP are hereby entered into and made part of
the public hearing record and the record of decision for this case.
Conclusion
The special permit to permit 6,000 cubic yards of fill at the location described is granted
based on the findings set forth above and subject to the following conditions:
1. That the site be filled in accordance with Exhibit A, Wolfe Park Fill Plan.
2. That the Public Works Department certify that the fill is in accordance with the
approved fill plan.
3. That conditions 1 through 2 be completed by August 31, 1990.
