HomeMy WebLinkAbout89-121 - ADMIN Resolution - City Council - 1989/08/21r i 1 RESOLUTION NO. 89-121 A RESOLUTION RESCINDING RESOLUTION NUMBERS 85-111 AND 84- 46 ADOPTED ON AUGUST 5, 1985 AND APRIL 16, 1984 RESPECTIVELY, AND GRANTING SPECIAL (CONDITIONAL USE) PERMIT UNDER SECTION 14-124(2)(A) OF THE ST. LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO ALLOW OFFICE -WAREHOUSE, RESEARCH AND DEVELOPMENT PILOT PLANT AT 1551 VERNON AVENUE SOUTH FINDINGS WHEREAS, Sandoz Nutrition has made application to the City Council for a special permit under Section 14-124(2)(a) of the St. Louis Park Ordinance Code to allow office - warehouse, research and development pilot plant at 1551 Vernon Avenue South within a DDD, Diversified Development District having the following legal description: That part of the Northwest Quarter of the Southwest Quarter lying West of the East 20.87 acres thereof Section 30, Township 29, Range 24, hereinafter called "the above-described property" lying South of the following described line; Commencing at the Southeast corner of the above-described property; thence North along the East line of the above-described property 705.21 feet to the point of beginning of the line to be described; thence at a right angle West to the West line of said Section 30 there terminating. Except the west 40 feet thereof; For purpose of this description, the West line of said Northwest Quarter of the Southwest Quarter is assumed to bear due North and South Except that part thereof lying westerly of a line run parallel with and distant 35 feet easterly the following described below: Line 1, Beginning at a point on the north and south quarter line of Section 4, Township 117 North, Range 21 West, distant 1897.81 feet north of the south quarter corner thereof; thence run southeasterly at an angle of 46 degrees, 33 minutes 56 seconds from said north and south quarter line (measured from south to east) for 45.52 feet; thence deflect to the right on a tangential curve having a radius of 381.97 feet and a delta angle of 46 degrees 11 minutes 18 seconds for 307.92 feet; thence on tangent to said curve for 28.89 feet and there terminating; The South 76.46 feet of the following described property to wit: That part of the Northwest Quarter of the Southwest Quarter lying West of the East 20.87 acres thereof, except the West 40 feet of said tract, in Section 30, Township 29, Range 24, hereinafter called "the above-described property", lying North of the following described line: Commencing at the southeast corner of the above-described property; thence North along the East line of the above- described property 705.21 feet to the point of beginning of the line to be described; thence at a right angle West to the West line of the above-described property and there terminating. That part of the Southwest Quarter of the Southwest Quarter of Section 30, Township 29 North, Range 24 West to the 4th Principal Meridian,lying North of a line drawn parallel with and 200 feet South, measured at right angles from the North line of said Southwest Quarter of the Southwest Quarter and lying West of the Southerly extension of the West line of the East 20.87 acres of the northwest Quarter of the Southwest Quarter of said Section, EXCEPT the West 40 feet thereof, all lying in Hennepin County, Minnesota. (Torrens Certificate 720846) And correctly shows the location of all easements as shown in Title Services, Inc., Commitment No. C25889, all buildings, structures, and improvements on said described property; that there are no visible encroachments onto adjoining properties, streets, or alleys by any of said buildings, structures, or improvements; that there are no visible rights-of-way or easements on said described property other than shown thereon; that there are no party walls or visible encroachments on said described property by buildings, structures, or other improvements situated on adjoining property except as shown on said plat of survey. Dated this 12th day of December, 1988 (Abstract) WHEREAS, the City Council has considered the advice and recommendation of the Planning Commission Case Numbers 89 -41 -SP and 84 -28 -SP and the effect of the proposed office -warehouse, research and development, pilot plant on the health, safety, and welfare of the occupants of the surrounding L' lids, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area and the effect of the use on the Comprehensive Plan; and WHEREAS, a special permit was issued regarding the subject property pursuant to Resolution Numbers 85-111 and 84-46 of the St. Louis Park City Council dated August 5, 1985, and April 16, 1984 respectively which contained conditions applicable to said property; and WHEREAS, due to changed circumstances, amendments to those conditions are now necessary, requiring the amendment of that special permit; and WHEREAS, it is the intent of this resolution to continue and restate the conditions of the permit granted by Resolution Numbers 85-111 and 84-46 to add the amendments now required, and to consolidate all conditions applicable to the subject property in this resolution; WHEREAS, the contents of Planning Commission Case File 89 -41 -SP and 84 -28 -SP are hereby entered into and made part of the public hearing record and the record of decision for this case. CONCLUSION NOW THEREFORE BE IT RESOLVED that Resolution No. 85-111 and 84-46 filed as Document Numbers 50257603, 4886389 respectively, are hereby rescinded and replaced by this resolution which continues and amends a special permit to the subject property for the purposes of permitting office -warehouse, research and development, pilot plant within the DDD, Diversified Development District at the location described above based on the following conditions: 1. That the site be developed, used and maintained in accordance with Exhibit A, Site Plan Sheet 2; Exhibit B, Floor Plan Sheet 2; and Exhibit C, Floor Plan Sheet 3 or Floor Plan Sheet 4. (Exhibits are on file in the City Development Department at the City of St. Louis Park.) 2. That the uses permitted be as follows: 154,700 gross square feet for warehouse in those areas marked Exhibit A as Tonka warehouse, Honeywell warehouse and vacant space, and the area identified as Banks under Options A, B or C be permitted as shown on the schedule. 3. That the site be improved for parking of 396 vehicles permitting a portion of the spaces next to the south side of the building to be used only when loading dock access is not necessary. 4. That the applicant and owners agree and understand that the City does not intend to allow any on -street parking adjacent to or nearby the subject property and that the owner and/or tenants occupying the subject property are responsible to provide additional parking on the subject property or on adjacent properties should the demand or need occur. 5. That all outdoor lighting be directed perpendicular to the ground and no lighting, if installed, be mounted at a height greater than 30 feet. 6. That all parking improvements, striping, landscaping, sidewalks, and all other items included on the exhibits be completed by October 15, 1984, except installation of the parking lot dividers, completion of tree and shrub planting, and installation of the sidewalk which shall be completed by May 15, 1986. 7. The site shall be developed, used and maintained in accordance with Exhibit D - Site Plan, Exhibit E - Landscape Plan and Exhibit F - Building Plan to the extent of showing the general layout of uses within the building. 8. At least 281 parking stalls shall be striped on the asphalt portions of the property. If conditions warrant, at its sole discretion, the City may request an additional 79 stalls be provided, as shown on the site plan, on the east side of the building. 9.
