LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO ALLOW A CLASS IV RESTAURANT AT 8332 HIGHWAY 7 FINDINGS WHEREAS, Daniel A. O'Bresky (Knollwood Mall) has made application to the City Council for a special permit under Section 14-124.101 of the St. Louis Park Ordinance Code to allow a Class IV restaurant at 8332 Highway 7 within a PUD, Planned Unit Development District having the following legal description: Commencing at intersection of North line of South 1/2 of Southeast 1/4 of Section 18, Township 117, Range 21 with center line of Aquila Avenue; thence Southerly along said center line to Northerly line of State Highway No. 7; thence Easterly along said Northerly line to West line of East 417.62 feet of South 1/2 of Southeast 1/4; thence North along said West line to South line of North 499.5 feet thereof; thence West along said South line to West line of East 783 feet of South 1/2 of Southeast 1/4; thence North along West line thereof to North line thereof; thence West to beginning, except roads. (Abstract) (also known as 8332 Highway 7 Knollwood Mall) WHEREAS, the City Council has considered the advice and recommendation of the Planning Commission Case Nos. 78 -130 -SP, 80 -96 -SP, 81 -89 -SP, 82 -20 -SP, 83 -15 -SP, 85 -63 - SP, 86 -29 -SP, 87 -2 -SP, and 89 -43 -SP, and the effect of the proposed Class IV restaurant on the health, safety, and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area and the effect of the use on the Comprehensive Plan; and WHEREAS, a special permit was issued regarding the subject property pursuant to Resolution No. 87-15 of the St. Louis Park City Council dated February 17, 1987 which contained conditions applicable to said property; and WHEREAS, due to changed circumstances, amendments to those conditions are now necessary, requiring the amendment of that special permit; and WHEREAS, it is the intent of this resolution to continue and restate the conditions of the permit granted by Resolution No. 87-15 to add the amendments now required, and to consolidate all conditions applicable to the subject property in this resolution;
