LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO PERMIT CONSTRUCTION OF A BILLBOARD FOR PROPERTY ZONED DDD, DIVERSIFIED DEVELOPMENT DISTRICT LOCATED AT 5120 CEDAR LAKE ROAD BE IT RESOLVED BY the City Council of the City of St. Louis Park: Findings 1. Naegele Outdoor Advertising Co. has made application to the City Council for a special permit under Section 14-185.05(3)(a)(4) of the St. Louis Park Ordinance Code for the purpose of constructing a billboard within a DDD, Diversified Development District located at 5120 Cedar Lake Road for the legal description as follows, to -wit: That part of the Northwest Quarter of the Northwest Quarter of Section 31, Township 29 North, Range 24 West, Hennepin County, Minnesota, described as follows: Beginning at the intersection of the westerly right of way line of Trunk Highway No. 100 as now located and established, with a line 286 feet southeasterly from, measured at right angles to and parallel with the southeasterly right of way line of Cedar Lake Road; thence on an assumed bearing of South 63 degrees 34 minutes 00 seconds West along said parallel line, 380. feet; thence southwesterly 172.47 feet along a tangential curve, concave to the southeast, having a radius of 180.99 feet and a central angle of 54 degrees 36 minutes 00 seconds; thence South 08 degrees 58 minutes 00 seconds West, tangent to said curve, 48.50 feet; thence southerly 173.34 feet along a non-tangential curve, concave to the west, having a radius of 467.37 feet, a central angle of 21 degrees 14 minutes 59 seconds and a chord bearing of South 10 degrees 28 minutes 12 seconds West to an intersection with the center line of County Road No. 16 as described in Document No. 2826324; thence easterly 143.33 feet along said center line, to the northwesterly right of way line of the Burlington Northern Railroad Company; thence northeasterly 382.97 feet along said northwesterly right of way line to the westerly right of way line of said Trunk Highway No. 100; thence northerly 316.57 feet along the westerly right of way line of said highway to the point of beginning; excepting therefrom the right of way of County Road No. 16 as now located and established; except road 2. The City Council has considered the advice and recommendation of the Planning Commission (Case No. 89 -36 -SP) and the effect of the proposed construction of a billboard on the health, safety and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area, the effect of the use on the Comprehensive Plan, and compliance with the intent of the Zoning Ordinance. 3. The Council has determined that the construction of a billboard will not be detrimental to the health, safety, or general welfare of the community nor will it cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding property values, and the proposed construction of a billboard is in harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan. 4. The contents of Planning Case File 89 -36 -SP are hereby entered into and made part of the public hearing record and the record of decision for this case. Conclusion The special permit to permit construction of a billboard at the location described is granted based on the findings set forth above and subject to the following conditions: 1. That the site be developed in accordance with Exhibit A, Site Plan; Exhibit B, Detail Plan and Elevation. 2. That the location of the billboard be at least 80 feet from the closest road surface of State Highway 100 including entrance ramps and frontage road. 3. That improvements be completed by December 15, 1989.
