A RESOLUTION OF FINDINGS REGARDING THE APPLICATION OF
EDWIN M. BELL (BERNARD AND ROSE HOROVITZ) FOR A SPECIAL
PERMIT UNDER SECTIONS 14-126(5) AND 14-141(9) OF THE ST. LOUIS
PARK ORDINANCE CODE RELATING TO ZONING TO PERMIT THE
CONSTRUCTION OF A SIX UNIT TOWNHOME DEVELOPMENT FOR
PROPERTY ZONED R-1, SINGLE FAMILY RESIDENCE AND R-4,
MULTIPLE FAMILY RESIDENCE DISTRICTS LOCATED AT 4211-4221
SUNSET BOULEVARD AND 2915-2919 JOPPA AVENUE SOUTH
BE IT RESOLVED BY the City Council of St. Louis Park, Minnesota
1. On May 31, 1989, Edwin M. Bell (Bernard and Rose Horovitz) filed an application
seeking a special permit to permit a six unit townhome development for property located in
the R-1 Single Family residence and R-4, Multiple Family Residence District, at 4211-4221
Sunset Boulevard and 2915-2919 Joppa Avenue South for the following legal description, to
wit:
Lots 1, 2, 3, 14 and 15, Block 4, Sunset Gables Second Division (Abstract)
2. On June 7, 1989 the Planning Commission reviewed the request and recommended
approval of the special permit on a vote of 3-0-1.
3. On July 10, 1989 the City Council held a public hearing, received testimony from the
public, discussed the application, closed the public hearing and authorized preparation of a
resolution of denial on a vote of 6-0-1.
4. Based on the testimony, evidence presented, and files and records, the City
Council makes the following findings of fact:
Findings of Fact
The City Council does hereby find that the proposed six unit townhouse development is
inconsistent with City policies contained in the Comprehensive Plan and does not comply
with City ordinance regulating cluster development. More specifically,
1. Section 14-126(5)(a) of the Zoning Ordinance states that "The applicant shall
clearly demonstrate through his application and site plan that a superior
development would result by clustering". Furthermore, Section 14-126(5)(f) of
the Zoning Ordinance states that "Building location, building
groupings...building forms....shall be factors in determining the suitability and
superiority of the proposed development".
Under current zoning, only two (2) single family homes could be built on the
properties facing on Joppa Avenue while the proposed development has three
units facing on Joppa Avenue. As a result of the additional unit and the
height of the unit of three stories, which height is greater than the
neighboring one and two story houses, the resulting building mass in close
proximity to single family houses does not present a superior, level of
development over conventional development of the site.
2. Section 14-126(5)(e) of the Zoning Ordinance states that "The density of
development shall not exceed the density allowed in the zone".
Approximately 21,336 square feet of the site is located in the R-1 zone. The
minimum lot area per dwelling unit allowed in the R-1 zone is 9,000 square
feet per dwelling unit. The proposed development has three dwelling units in
the R-1 portion of the site or approximately 7,112 square feet of lot area per
dwelling unit in the R-1 zone.
5. The contents of Planning Case File 89 -33 -SP are hereby entered into and made part of
the public hearing record and the record of decision for this case.
CONCLUSION
The applicant's request for a special permit for a six unit townhome development at 4211-
4221 Sunset Boulevard and 2915-2919 Joppa Avenue South is hereby denied based on the
findings set forth above.
