HomeMy WebLinkAbout89-104 - ADMIN Resolution - City Council - 1989/07/174teadel, Sp,eieg,a gq,ptci RESOLUTION NO. 89-104 A RESOLUTION RESCINDING RESOLUTION NO. 89-60 ADOPTED ON MAY 15, 1989, AND RESCINDING RESOLUTION 6696 ADOPTED ON NOVEMBER 3, 1980, AND GRANTING SPECIAL (CONDITIONAL USE) PERMIT UNDER SECTION 14-156(17) OF THE ST. LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO ALLOW A CLASS I RESTAURANT IN THE B-2, GENERAL BUSINESS DISTRICT AT 6501 WAYZATA BOULEVARD FINDINGS WHEREAS, Northstar Pizza Properties (Shelly's Woodroast - Two, Inc.) has made application to the City Council for a special permit under Section 14-156(17) of the St. Louis Park Ordinance Code to allow a Class I restaurant at 6501 Wayzata Boulevard within a B-2, General Business District having the following legal description: Lot 4, Block 1, Lou Park Addition (Abstract) WHEREAS, the City Council has considered the advice and recommendation of the Planning Commission Case Numbers 89 -52 -SP, 89 -15 -SP, and 80 -81 -SP and the effect of the proposed Class I restaurant on the health, safety, and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area and the effect of the use on the Comprehensive Plan; and WHEREAS, a special permit was issued regarding the subject property pursuant to Resolution Numbers 89-60 and 6696 of the St. Louis Park City Council dated mAY 15, 1989 and November 3, 1980, respectively, which contained conditions applicable to said property; and WHEREAS, due to changed circumstances, amendments to those conditions are now necessary, requiring the amendment of that special permit; and WHEREAS, it is the intent of this resolution to continue and restate the conditions of the permit granted by Resolution Numbers 89-60 and 6696 to add the amendments now required, and to consolidate all conditions applicable to the subject property in this resolution; WHEREAS, the contents of Planning Commission Case Files 89 -52 -SP, 89 -15 -SP and 80- 81 -SP are hereby entered into and made part of the public hearing record and the record of decision for this case. CONCLUSION NOW THEREFORE BE IT RESOLVED that Resolution No. 89-60 filed as Document No. 5536375 and Resolution 6696 (not previously filed) is hereby rescinded and replaced by this resolution which continues and amends a special permit to the subject property for the purposes of permitting a Class I restaurant within the B-2 General Business District at the location described above based on the following conditions: 1. That the site shall be operated and maintained in accordance with Exhibit A, Site Plan, and Exhibit B, Floor Plan/Elevations. ; 2. That all lighting be directed perpendicular to the ground and away from surrounding properties and right of way. 3. That all trash storage be indoors. 4. That all landscaping be completed by July 15, 1981. 5. That the site shall be developed, used and maintained in accordance with Exhibit C, Site Plan; Exhibit D, Floor Plan; Exhibits E and F, Elevations; Exhibit G, Landscape Plan; and Exhibit H, Plant Schedule. 6. That concrete curb and gutter or curb stops be placed long the south edge and west edge of the south parking lot. 7. That all improvements included in conditions 1 through 6 be completed by May 31, 1990. 8. That Exhibits C, D and E which are included in Condition 5 be replaced by Exhibit I, Revised Site Plan, Exhibit J, Revised Floor Plan; and Exhibit K, Revised Elevation. 9. That all improvements modified through Condition 8 be completed by June 30, 1990.
