A RESOLUTION OF FINDINGS REGARDING THE APPLICATION OF
GLASS ONE PARTNERS FOR A VARIANCE UNDER SECTION 14-158(4)
AND SECTION 14-187(3)(3)(G) OF THE ST. LOUIS PARK ORDINANCE
CODE RELATING TO ZONING TO PERMIT A PARKING SETBACK OF 0
FEET INSTEAD OF THE REQUIRED 6 FEET IN A FRONT YARD FOR
PROPERTY LOCATED IN THE B-2 GENERAL BUSINESS DISTRICT AT
6801 WAYZATA BOULEVARD
BE IT RESOLVED BY the City Council of St. Louis Park, Minnesota
1. On May 15, 1989 Glass One Partners filed an application seeking a variance to
permit a parking setback of 0 feet instead of the required 6 feet in a front yard for property
located in the B-2 General Business District at 6801 Wayzata Boulevard for the following
legal description, to wit:
Lots 1 through 8 Richmond, except highway (Torrens Certificate #523765)
also known as 6801 Wayzata Boulevard
2. On May 25, 1989 the Board of Zoning Appeals reviewed the request and recommended
denial of the variance on a vote of 4-1.
3. On July 10, 1989 the City Council held a public hearing, received testimony from the
public, discussed the application, and authorized preparation of a resolution of denial on a
vote of 6-0-1.
4. Based on the testimony, evidence presented, and files and records, the City Council
makes the following findings:
1. - Approval of this request would set a precedent for other properties fronting on
Highway 12 and would not be in compliance with the spirit and intent of the
Zoning Ordinance.
2. There are no exceptional conditions on the property in question which would
justify approval of the requested variance.
3. It appears that the required number of parking spaces can be provided on the
site without granting the variance.
4. No hardship is incurred by the owner through the denial of this variance
because a reasonable use of the property is currently being made and can be
made without provision of parking in the front setback.
5. It appears that granting this variance would serve solely as a convenience to
the property owner inasmuch as the legally required parking can be provided
elsewhere on the site and it is not necessary to utilize the front setback in
order to meet parking requirements.
5. The contents of Planning Case File 89 -27 -VAR are hereby entered into and made part
of the public hearing record and the record of decision for this case.
CONCLUSION
The applicant's request for a variance to permit a parking setback of 0 feet
instead of the required 6 feet in a front yard at 6801 Wayzata Boulevard is hereby
denied based on the findings set forth above.
