RESOLUTION NO. 89-10 REPLACEMENT
A RESOLUTION GRANTING VARIANCE IN PARKING FROM SECTION
14-187(2)(b) and 14-187(4)(s) OF THE ORDINANCE CODE RELATING TO
ZONING TO PERMIT THE REDUCTION OF AVAILABLE OFF-STREET
PARKING SPACES FROM THE REQUIRED 639 SPACES TO 586 SPACES
IN THE I-1, INDUSTRIAL DISTRICT AT 7500 EXCELSIOR BOULEVARD
BE IT RESOLVED BY the City Council of St. Louis Park, Minnesota:
Findings
1. Pickwick International Inc. (The Musicland Group) has applied for a variance
from Section 14-187(2)(b) and 14-187(4)(s) of the Ordinance Code relating to zoning
to permit the reductionn of available off-street parking spaces from the required
639 spaces to 586 spaces for a general office/warehouse located in the I-1, Industrial
District at the following location, to -wit:
That part of the Northwest Quarter of the Southwest Quarter of Section
20, Township 117, Range 21 described as follows: Commencing at the
Northeast corner of said Quarter -Quarter, thence westerly along the
North line thereof 700 feet; thence southerly along a line parallel with
the west line of said Quarter -Quarter 642.5 feet to the center line of
Excelsior Avenue; thence Easterly along the center line of Excelsior
Avenue to the East line of said Quarter -Quarter; thence northerly along
said East line to point of beginning, except the West 49 feet of the
Southerly 461 feet thereof.
Subject to public streets on the Southerly 33 feet and the Easterly 33
feet thereof, as shown in deed Doc. No. 437549, Files of Registrar of
Titles;
That part of the Southwest Quarter of the Northwest Quarter lying
South and East of the center line of Powell Road; That part of the
Northwest Quarter of the Southwest Quarter described as follows:
Commencing at a point on the North line of the Northwest Quarter of
the Southwest Quarter, 700 feet West of the Northeast corner thereof,
thence South along a line parallel with the West line thereof to a point
461 feet North of the center line of Excelsior Boulevard as measured
along said parallel line, which is the actual point of beginning of the
tract to be -d-eseribede g-sa-id-parallel--li-ae-to- t -he -Nor- h
line of the Northwest Quarter of the Southwest Quarter, thence West
along said North line 185.3 feet, thence South along a line deflecting
to the left 90.008 degrees to a point of intersection with a line running
parallel with the center line of Excelsior Boulevard from the point of
beginning, thence Easterly to the point of beginning; the Southerly
boundary of said tract is marked by Judicial Landmarks set pursuant
to Torrens Case No. 12986; all in Section 20, Township 117, Range 21.

2. The Board of Zoning Appeals has reviewed the application for a variance
(Case No. 88 -105 -VAR) and has recommended to the City Council that the application
be granted.

3. The Council has considered the effect of the proposed variance upon the
health, safety and welfare of the community, existing and anticipated traffic
conditions, light and air, danger of fire, risk to the public safety, the effect on
values of property in the surrounding area, and the effect of the proposed variance
upon the Comprehensive Plan.
4. Because of conditions on the subject property and on the surrounding
property, it is possible to use the subject property in such a way that the proposed
variance will not impair an adequate supply of light and air to adjacent property,
unreasonably increase the congestion in the public streets, increase the danger of
fire, endanger the public safety, unreasonably diminish or impair health, safety,
comfort, morals, or in any other respect be contrary to the intent of the Zoning
Ordinance and the Comprehensive Plan.
5. The special conditions applying to the structure or land in question are
peculiar to such property or immediately adjoining property and do not apply generally
to other land or structures in the district in which such land is located.
6. The granting of the application is necessary for the preservation and
enjoyment of a substantial property right of the applicant. It will not merely serve as
a convenience to the applicant but is necessary to alleviate demonstrable hardship
or difficulty.
7. The following conditions and safeguards are necessary in order to insure
and will in fact insure that there will be no unreasonably adverse consequences to
the granting of the variance:
a. The parking layout shall be as shown on Exhibit A, Site Plan
dated December 9, 1988, by Carlson Mjorund Architecture Ltd.
b. In the event Musicland vacates these premises, the receiving
loading doors shall be blocked up and the parking lot restriped
to its configuration with 639 stalls.
c. Musicland, or any successors or assigns, shall not intensify the
existing -use.
Conclusion
The application for a variance for the reduction of, available off-street parking
spaces from the required 639 spaces to 586 spaces is granted based upon the findings
set forth above.
