RESOLUTION NO. 89-09
A RESOLUTION RESCINDING RESOLUTION NO. 6911 ADOPTED ON
AUGUST 3, 1981, AND GRANTING SPECIAL (CONDITIONAL USE) PERMIT
UNDER SECTION 14-185.04(06) OF THE ST. LOUIS PARK ORDINANCE
CODE RELATING TO ZONING TO ALLOW A FREESTANDING SIGN FOR
PROPERTY LOCATED IN THE R-1, SINGLE FAMILY RESIDENCE
DISTRICT, AT 9001 CEDAR LAKE ROAD
FINDINGS
WHEREAS, Westwood Lutheran Church has made application to the City Council for
a special permit under Section 14-185.04(06) of the St. Louis Park Ordinance Code to allow
a freestanding sign at 9001 Cedar Lake Road within an R-1, Single Family Residence
District having the following legal description:
Section 7, Township 117, Range 21, commencing at southeast corner of northeast
1/4 of southwest 1/4; thence west 200 feet; thence north parallel with east line
thereof 300 feet; thence deflecting 55 degrees 44 minutes left 532 9/10 feet;
thence deflecting 38 degrees 51 minutes left 190 feet; thence northerly at right
angle to center line of Cedar Lake Road; thence northeasterly along said center
line to east line of southwest 1/4; thence south to beginning, except road, also
known as 9001 Cedar Lake Road
WHEREAS, the City Council has considered the advice and recommendation of the
Planning Commission (Case No. 81 -62 -SP and 88 -107 -SP) and the effect of the proposed
freestanding sign on the health, safety, and welfare of the occupants of the surrounding
lands, existing and anticipated traffic conditions, the effect on values of properties in
the surrounding area and the effect of the use on the Comprehensive Plan; and
WHEREAS, a special permit was issued regarding the subject property pursuant to
Resolution No. 6911 of the St. Louis Park City Council dated August 3, 1981 which
contained conditions applicable to said property; and
WHEREAS, due to changed circumstances, amendments to those conditions are now
necessary, requiring the amendment of that special permit; and
WHEREAS, it is the intent of this resolution to continue and restate the conditions
of the permit granted b_y Resolution No. 6911 to add the amendments now reqiiited, And
to consolidate all conditions applicable to the subject property in this resolution;
CONCLUSION
NOW THEREFORE BE IT RESOLVED that Resolution No. 6911 is hereby rescinded
and replaced by this resolution which continues and amends a special permit to the subject
property for the purposes of permitting freestanding sign within the R-1, Single Family
Residence District District at the location described above based on the following conditions:
1. The improvements shall be completed in accordance with Exhibit A,
Grading, and Exhibit B, Cross -Sections.
2. The face of the fill area shall be seeded with a perennial grass and an
erosion control mat shall be placed over the fill area within ten days
of completion of the filling operation.
3. Section 14-123.100(2)(2) requires dedication of an easement along an
established body of water for several stated public purposes. Such
dedication shall extend a distance of 15' horizontally from the ordinary
high water level.
4. All work on the proposed improvements shall be completed by May 30,
1982.
5. That the site be developed, used an maintained in accordance with
Exhibit C - Site Plan, as amended to delete the freestanding sign at
the westerly end of the property; and Exhibit D Sign Detail.
6. That all improvements be completed by December 31, 1989.
