A RESOLUTION RESCINDING RESOLUTION NO. 88-192 ADOPTED ON
DECEMBER 19, 1988, AND GRANTING SPECIAL (CONDITIONAL USE)
PERMIT UNDER SECTION 14-124.101(2) OF THE ST. LOUIS PARK
ORDINANCE CODE RELATING TO ZONING TO ALLOW EXPANSION OF
DRIVE -UP TELLER FACILITY FOR PROPERTY ZONED PUD, PLANED
UNIT DEVELOPMENT DISTRICT, AT 8020 HIGHWAY 7
FINDINGS
WHEREAS, TCF Banking and Savings, F.A. (General Growth Managment, Inc.) has made
application to the City Council for a special permit under Section 14-124.101(2) of the St.
Louis Park Ordinance Code to allow expansion of drove -up teller facility at 8020 Highway 7
within a PUD, Planned Unit Development District having the following legal description:
That part of Section 18, Township 117, Range 21, Hennepin County, described
as follows: That part of the east 417.62 feet of the Southeast Quarter of
Southeast Quarter lying South of the North 499.65 feet thereof and North of
Highway 7 (Abstract)
WHEREAS, the City Council has considered the advice and recommendation of the
Planning Commission (Case No. 74 -48 -SP, 88 -94 -SP and 89 -31 -SP) and the effect of the
proposed expansion of the drive -up teller facility on the health, safety, and welfare of the
occupants of the surrounding lands, existing and anticipated traffic conditions, the effect
on values of properties in the surrounding area and the effect of the use on the
Comprehensive Plan; and
WHEREAS, a special permit was issued regarding the subject property pursuant to
Resolution No. 88-192 of the St. Louis Park City Council dated December 19, 1988 which
contained conditions applicable to said property; and
WHEREAS, due to changed circumstances, amendments to those conditions are now
necessary, requiring the amendment of that special permit; and
WHEREAS, it is the intent of this resolution to continue and restate the conditions of
the permit granted by Resolution No. 88-192 to add the amendments now required, and to
consolidate all conditions applicable to the subject property in this resolution;
WHEREAS, the contents of planning case files 74 -48 -SP, 88 -94 -SP and 89 -31 -SP are
hereby entered into and made part of the public hearing record and the record of decision
for this case.
CONCLUSION
NOW THEREFORE BE IT RESOLVED that Resolution No. 88-192 filed as Document
No. 5490718 is hereby rescinded and replaced by this resolution which continues and
amends a special permit to the subject property for the purposes of permitting expansinof
the drive -up teller facility within the PUD, Planned Unit Development District at the
location described above based on the following conditions:
1. The site be developed, used and maintained in accordance with Exhibit A, Site Plan -
Landscape Plan dated December 28, 1974; Exhibit B, Elevation Plans; and Exhibit
C, Sign Plans.
2. The concrete sidewalk shown on the Site Plan shall be maintained free of signs and
obstructions for a width of 5 feet.
3. That all construction, median islands, curbing, and landscapiung, as required be
completed before July 15, 1975.
4. The construction of a drive -up facility and canopy is approved subject to the
condition that the site shall be developed, used and maintained in accordance with
Exhibit D - Site Plan; Exhibit E - Elevation Plan; and Exhibit F - Landscaping Plan.
5. All improvements shall be completed by October 31, 1989
6. That Condition 4 be modified to read as follows:
The construction of a drive -up facility and canopy is approved subject to the
condition tht the site shall be developed, used and maintained in accordance with
Exhibit D - Site Plan, Exhibit E - Elevation Plan and Exhibit G - Planting Plan.
