RICHARD HANDELMAN FOR AN INTERPRETATION OF SECTION 14-106(1) OF THE ZONING ORDINANCE RELATIVE TO THE EXPANSION OF A MEDICAL OFFICE FACILITY LOCATED IN THE R-1, SINGLE FAMILY RESIDENCE DISTRICT, AT 9445 MINNETONKA BOULEVARD BE IT RESOLVED BY THE CITY OF ST. LOUIS PARK, MINNESOTA: Findings 1. On December 18, 1987, the City of St. Louis Park, Minnesota, received an application from Samuel L. Stern of Bernick and Stern, P.A., representing Dr. Richard Handelman, for a building permit to convert the unfinished portions of an existing medical office facility to office space for property located within an R-1, Single Family Residence District, at 9445 Minnetonka Boulevard. On January 6, 1988, the application was denied by the Director of Inspectional Services on the basis that: a. The existing office use is non -conforming and any increase in the square footage of office use constitutes an illegal expansion of a non -conforming use in violation of Section 14-106(1) of the St. Louis Park Ordinance Code. b. The proposed expansion does not provide the required number of off-street parking spaces in violation of Section 14-187(4) of the St. Louis Park Ordinance Code. 2. On February 16, 1988, a request was filed by Bernick and Stern, P.A., on behalf of Dr. Richard Handelman, to appeal the denial by the Director of Inspectional Services of the requested office expansion. 3. On February 5, 1988, the Board of Zoning Appeals reviewed the request to appeal the denial and passed a motion to concur in the interpretation of the Director of Inspectional Services on a vote of 4-0. 4. On March 21, 1988, a public hearing was held, and the City Council passed a motion on'a vote of 4-0 to continue the public hearing to April 18, 1988. 5. The applicant has provided evidence that several years ago, a City employee and the City attorney had approved office use for the property. 6. On April 18, 1988, the City Council continued the public hearing, discussed the application and passed a motion on a 5-2 vote authorizing preparation of a resolution approving the requested expansion. CONCLUSION Based upon the findings set forth above, the application for a building permit to convert the unfinished portions of an existing medical office facility to office space is hereby approved, provided no increase in gross square footage is pr000sed and provided the request otherwise meets all the other provisions of the City code Adopted by the City Council May 16, 1988 Reviewed for Administration: 6) AL,,,k, Approved as to form and execution:
