HomeMy WebLinkAbout88-47 - ADMIN Resolution - City Council - 1988/05/021 RESOLUTION NO. 88-47 A RESOLUTION OF FINDINGS REGARDING THE APPLICATION OF BRYAN KIHLE (ESTATE OF JERGEN JOHNSON) FOR VARIANCES IN LOT AREA, LOT WIDTH AND SIDE YARD SETBACK FOR PROPERTY LOCATED IN THE R-2, SINGLE FAMILY RESIDENCE DISTRICT, AT 2903 KENTUCKY AVENUE BE IT RESOLVED BY the City Council of St. Louis Park, Minnesota: 1. On March 15, 1988, Bryan Kihle filed an application seeking variances in lot area, lot width and side yard setback to permit the creation of two lots each having a width of 40 feet instead of the required 60 feet and an area of 5,175 square feet instead of the required 7,200 square feet, and for the northerly lot to have a side yard setback abutting a street of 12 feet instead of the required 15 feet for property located in the R-2, Single Family Residence District, at 2903 Kentucky Avenue, for the following legal description, to wit: Lots 28 and 29, Block 17, "The Bronx" (Abstract) 2. On March 24, 1988, the Board of Zoning Appeals reviewed the request and recommended denial of the variances on a vote of 4-0. 3. On April 18, 1988, the City Council held a public hearing, received testimony from the public, discussed the application and authorized preparation of a resolution of denial with findings on a vote of 7-0. 4. Based on the testimony, evidence presented and files and records, the City Council makes the following findings: a. The requested variances do not meet the requirements of Sections 14-219 and 14-220.11 of the Zoning Ordinance necessary to be met for the City Council to grant variances. There are no factors related to the shape, size or other extraordinary conditions of the lot which prevent a reasonable use. b. Granting of the requested variances is not necessary for the preservation and enjoyment of a substantial property right. c. Granting of the requested variances would be contrary to the intent and provisions of the Zoning Ordinance. d. There is no demonstrable or undue hardship under the terms of the Zoning Ordinance of Minnesota Statute, and, therefore, conditions necessary for granting the requested variances do not exist. The subject property is presently a legal lot in the R-2 District and can be used for the construction of a single familly dwelling. e. Granting of the variances may have an adverse impact on the adjacent property. CONCLUSION The applicant's request for variances in lot area, lot width and side yard setback at 2903 Kentucky Avenue is hereby denied based on the findings set forth above.
