KOHNER TO CHANGE THE ZONING FROM R-2, SINGLE FAMILY RESIDENCE DISTRICT, TO R-4, MULTIPLE FAMILY RESIDENCE DISTRICT, FOR PROPERTY LOCATED AT 7525 HIGHWAY 7. BE IT RESOLVED BY THE CITY OF ST. LOUIS PARK: 1. On March 2, 1988, Opal A. Kohner filed an application to amend the zoning ordinance by changing the zoning map district boundary at 7525 Highway 7 from R-2, Single Family Residence District, to R-4, Multiple Family Residence District, for the legal description as follows, to wit: All of Lot 47 and part of Lots 48 and 49, Block 317, Rearrangement of St. Louis Park, except highway (Abstract) 2. On March 16, 1988, the Planning Commission reviewed the request and recommended denial of the zoning change on a vote of 7-0. 3. On April 18, 1988, the City Council held a public hearing, received testimony from the public, discussed the application and authorized preparation of a resolution of denial on a 7-0 vote. 4. Based on the testimony, evidence presented, files and records, and the staff report dated March 10, 1988, which is hereby incorporated by reference, the City Council makes the following findings: a) The requested R-4 zoning is inconsistent with the adopted Comprehensive Plan which designates the property for low density residential use. b) The existing R-2 zoning permits a reasonable use of the property which is and has been used for single family use. c) There is no evidence to suggest that the existing R-2 zoning is improper or incorrect. d) There is no evidence to suggest that there was an error in the original zoning. CONCLUSION The application to change the zoning from R-2, Single Family Residence District, to R-4, Multiple Family Residence District, at 7525 Highway 7, is hereby denied based upon the findings set forth above and on the ground that conditions for approval do not exist.
