RESOLUTION GIVING APPROVAL FOR REGISTERED LAND SURVEY
2518 France Avenue South and
2517 Huntington Avenue South
BE IT RESOLVED BY the City Council of St. Louis Park:
Findings
1. John A. and Elaine A. Bergquist, and Jeffrey Lloyd and Nancy Lou Tellett-
Royce, owners and subdividers of the land proposed to be platted as a Registered Land
Survey have submitted an application for approval of final plat of said subdivision in the
manner required for platting of land under the St. Louis Park Ordinance Code, and all
proceedings have been duly had thereunder.
2. The proposed final plat has been found to be in all respects consistent with
the City Plan and the regulations and requirements of the laws of the State of Minnesota
and the ordinances of the City of St. Louis Park.
3. The proposed plat is situated upon the following described lands in Hennepin
County, Minnesota, to -wit:
Tract A
That part of Block 4, Cedarwood
That part of Lot 10, Block 6, "Basswood" and
That part of Lots 2 and 9, Block 6, "Basswood"
All lying Northerly of a line drawn from a point in the E-asterly line of said Lot 2
distant 37 1/2 feet Southerly as measured along said Easterly line from the Northeast
corner of said Lot to a point in the Westerly line of said Lot 9 distant 37 1/2 feet
Southerly as measured along said Westerly line of said Lot from the Northwest corner
of said Lot 9 lying Easterly of a line drawn from a point on the South line of said
premises distant 10 feet West measured along said South line from the Easterly line
of said Lot 9 to the point at which a Northerly extension of the Easterly line of
said Lots 9 and 10 would intersect the Northerly line of Block 4, Cedarwood;
according to the plat thereof on file or of record in the office of the Registrar of
Titles in and for -said County.
Lot 1, Block 6, "Basswood", according to the plat thereof on file or of record in
the office of the Registrar of Titles in and for said County. (Certificate of Title
No. 644563)
Tract B:
That part of Block 4, Cedarwood;
That part of Lot 10, Block 6, 'Basswood", and
That part of Lot 9, Block 6, "Basswood," lying Northerly of a line drawn from a point
in the Easterly line of Lot 2 in said Block 6 distant 37.5 feet Southerly measured
along said Easterly line from the Northeast corner of said Lot 2 to a point in the
Westerly line of said Lot 9, distant 37.5 feet Southerly measured along said Westerly
line of said Lot 9 from the Northwest corner of said Lot 9; excepting from all of said
premises that part thereof lying Easterly of a line drawn from a point on the South line
of said premises distant 10 feet measured along said South line from the Easterly line of
said Lot 9 to the point at which a Northerly extension of the Easterly line of said Lots 9
and 10 would intersect the Northerly line of Block 4, Cedarwood, according to the plat
thereof on file or of record in the office of the Registrar of Titles in and for said
County. (Certificate of Title No. 690637)
Conclusion
1. The proposed final plat of the Registered Land Survey for property at 2518
France Avenue South and 2715 Huntington Avenue South is hereby approved and accepted
by the City as being in accord and conformity with all ordinances, City plans and
regulations of the City of St. Louis Park and the laws of the State of Minnesota, subject
to the following conditions:
That all utilities be retained and/or placed underground
provided, however, that this approval is made subject to Certification by the City Clerk
as provided for in Section 14-303(3)(e) of the St. Louis Park Ordinance Code.
2. The City Clerk is hereby directed to supply two certified copies of this
Resolution to the above-named owner and subdivider, who is the applicant herein.
3. The Mayor and City Manager are hereby authorized to execute all contracts
required herein, and the City Clerk is hereby directed to execute the certificate of
approval on behalf of the City Council upon the said plat when all of the conditions set
forth in Paragraph No. 1 above and Section 14-303(3)(e) of the St. Louis Park Ordinance
Code have been fulfilled.
4. Such execution of the certificate upon said plat by the City Clerk, as required
under Section 14-303(3)(e), shall be conclusive showing of proper compliance therewith by
the subdivider and City officials charged with duties above-described and shall entitle
such plat to be placed on record forthwith without further formality.
