HomeMy WebLinkAbout88-159 - ADMIN Resolution - City Council - 1988/10/17Replacement RESOLUTION NO. 88-159 RESOLUTION GIVING APPROVAL FOR FINAL PLAT OF ON THE AVENUE BE IT RESOLVED BY the City Council of St. Louis Park: Findings 1. The St. Louis Park Economic Development Authority, owners and subdividers of the land proposed to be platted as On The Avenue have submitted an application for approval of final plat of said subdivision in the manner required for platting of land under the St. Louis Park Ordinance Code, and all proceedings have been duly had thereunder. 2. The proposed final plat has been found to be in all respects consistent with the City Plan and the regulations and requirements of the laws of the State of Minnesota and the ordinances of the City of St. Louis Park. 3. The proposed plat is situated upon the following described lands in Hennepin County, Minnesota, to -wit: All that part of the Northwest Quarter of the Northwest Quarter of Section 7, Township 28, Range 24, described as follows: Commencing at the Northwest corner of said Section 7, thence South along the West line of said Section 7, 443.71 feet; thence East parallel to the North line of said Section 7, 967.1 feet; thence South parallel to the East line of the Northwest Quarter of the Northwest Quarter of said Section 7 to a point on the Northwesterly line of Excelsior Avenue as the same is now opened and laid out; thence Southwesterly along the said Northwesterly line of Excelsior Avenue 152.3 feet to the actual point of beginning of land to be described; thence Northwesterly at right angles to said Northwesterly line of Excelsior Avenue 219.35 feet; thence West parallel to the North line of said Section 7, 120.5 feet more or less to a point 318.44 feet Northwesterly from and in a line that extends at right angles from the center line of said Excelsior Avenue from a point therein 713.69 feet Southwesterly from the intersection of said center line with the East line of the Northwest Quarter of the Northwest Quarter of said Section; thence Southeasterly along said right angle line to the northerly line of said Excelsior Avenue; thence Northeasterly along the Northerly line of said Excelsior Avenue to the actual point of beginning. All that part of the Northwest Quarter of the Northwest Quarter of Section 7, Township 28, Range 24, described as follows: Commencing at the Northwest corner of said Section 7, thence South along the West line of said Section 7, 443.71 feet; thence East parallel to the North line of said Section 7, 624.50 feet to the actual point of beginning of the land to he described; thence continuing East from said actual point of beginning on said last described line 342.60 feet; thence South parallel to the East line of the Northwest Quarter of the Northwest Quarter of said Section 7 to a point on the Northwesterly line of Excelsior Avenue as the same is now opened and laid out; thence Southwesterly along the said Northwesterly line of Excelsior Avenue 152.30 feet; thence Northwesterly at right angles to said Northwesterly line of Excelsior Avenue 219.35 feet; thence West parallel to the North line of said Section 7, 120.50 feet more or less to a point 318.44 feet Northwesterly from and in a line that extends at right angles from the center line of said Excelsior Avenue from a point therein 713.69 feet southwesterly from the intersection of said center line with the East line of the Northwest Quarter of the Northwest Quarter of said Section; thence North to the point of beginning. That part of the Northwest Quarter of the Northwest Quarter, Section 7, Township 28, Range 24, described as commencing at the intersection of the center line of Excelsior Avenue with the east line of said Northwest Quarter of the Northwest Quarter (for the purpose of this description the east line of said Northwest Quarter of the Northwest Quarter is a line bearing South 0 degrees 18 minutes 12 seconds East from the northeast corner of said Northwest Quarter of the Northwest Quarter, assuming the north line of said Northwest Quarter of the Northwest Quarter as bearing East); thence South 66 degrees 12 minutes 29 seconds West along said center line a distance of 850.50 feet; thence North 23 degrees 47 minutes 31 seconds West a distance of 52.00 feet to the actual point of beginning; thence continuing North 23 degrees 47 minutes 31 seconds West a distance of 130.00 feet; thence South 69 degrees 19 â–ºninutes 29 seconds West a distance of 60.00 feet; thence South 23 degreees 47 minutes 31 seconds East a distance of 130.00 feet; thence North 69 degrees 19 minutes 29 seconds East a distance of 60.00 feet to the actual point of beginning, according to the Government Survey thereof, Hennepin County, Minnesota. That part of the Northwest Quarter of the Northwest Quarter of Section 7, Township 28, Range 24, described as commencing at the Northwest corner of said Northwest Quarter of the Northwest Quarter; thence South along the West line thereof 443.71 feet; thence East parallel with the North line of said Northwest Quarter of the Northwest Quarter a distance of 624.5 feet to the actual point of beginning; thence West along said parallel line 488.66 feet; thence South parallel with the West line of said Northwest Quarter of the Northwest Quarter a distance of 200 feet; thence East parallel with the North line of said Northwest Quarter of the Northwest Quarter a distance of 304.9 feet; thence Southerly 113 feet, more or less, to a point which is 450.33 feet Northwesterly and on a line erected perpendicular to the center line of Excelsior Boulevard from a point on said center line distant 850.5 feet Southwesterly along said center line from the East line of said Northwest Quarter of the Northwest Quarter; thence Northeasterly parallel with said center line 193.47 feet; thence Southerly to a point which is 318.44 feet Northwesterly and on a line erected perpendicular to the center line of Excelsior Boulevard from a point on said center line distant 713.69 feet Southwesterly along said center line from the East line of said Northwest Quarter of the Northwest Quarter; thence North to the actual point of beginning, all according to the Government Survey thereof the boundaries which are fixed by Judicial Landmarks set pursuant to Torrens Case No. 14938. All that part of the Northwest Quarter of the Northwest Quarter (N W4 NW4) of Section Seven (7), Township Twenty-eight (28), Range Twenty-four (24) bounded as follows: Beginning at a point on the center line of the "Minneapolis and Excelsior Road" (so-called) as now located across said subdivision of said Section which point of beginning is eight hundred fifty and five -tenths (850.5) feet southwesterly from the point formed by the intersection of the center line of said road with the east line of the Northwest Quarter of the Northwest Quarter (NW.2} NW4) of said Section; thence in a northwesterly direction at right angles with the center line of "Minneapolis and Excelsior Road" four hundred fifty and thirty-three one -hundredths (450.33) feet; thence in a northeasterly direction and parallel with the center line of said "Minneapolis and Excelsior Road" one -hundred ninety-three and forty-seven one -hundredths (193.47) feet; thence in a southerly direction one -hundred forty-three and fifty- four one -hundredths (143.54) feet to a point that is three -hundred eighteen and forty-four one -hundredths (318.44) feet northwesterly from and in a line that extends at right angles northwesterly from the center line of said "Minneapolis and Excelsior Road"; thence along said line a distance of sixty-eight and forty- four one -hundredths (68.44) feet; thence southwesterly on a line parallel to the center line of said Road one -hundred (100) feet; thence Southeasterly on a line parallel to the first mentioned line two -Hundred fifty (250) feet to an intersection with the center line of said Road; thence southwesterly along said center line thirty-six and eight -one one hundredths (36.81) feet to the point of beginning. (For purposes of this description the North line of said Northwest Quarter of the Northwest Quarter is assumed to bear East). Conclusion 1. The proposed final plat of On The Avenue is hereby approved and accepted by the City as being in accord and conformity with all ordinances, City plans and regulations of the City of St. Louis Park and the laws of the State of Minnesota, provided, however, that this approval is made subject to the opinion of the City Attorney and Certification by the City Clerk as provided for in Sections 14-303(3)(d) and (e) of the St. Louis Park Ordinance Code. 2. The City Clerk is hereby directed to supply two certified copies of this Resolution to the above-named owner and subdivider, who is the applicant herein. 3. The Mayor and City Manager are hereby authorized to execute all contracts required herein, and the City Clerk is hereby directed to execute the certificate of approval on behalf of the City Council upon the said plat when all of the conditions set forth in Paragraph No. 1 above and Section 14-303(3)(e) of the St. Louis Park Ordinance Code have been fulfilled. 4. Such execution of the certificate upon said plat by the City Clerk, as required under Section 14-303(3)(e), shall be conclusive showing of proper compliance therewith by the subdivider and City officials charged with duties above-described and shall entitle such plat to be placed on record forthwith without further formality.
