HomeMy WebLinkAbout88-145 - ADMIN Resolution - City Council - 1988/10/03RESOLUTION NO. 88-145 RESOLUTION GIVING APPROVAL FOR FINAL PLAT OF SILVERBERG ADDITION BE IT RESOLVED BY the City Council of St. Louis Park: Findings 1. Quality Metals, Inc. and Daniel Kutoff, owners and subdividers of the land proposed to be platted as Silverberg Addition have submitted an application for approval of final plat of said subdivision in the manner required for platting of land under the St. Louis Park Ordinance Code, and all proceedings have been duly had thereunder. 2. The proposed final plat has been found to be in all respects consistent with the City Plan and the regulations and requirements of the laws of the State of Minnesota and the ordinances of the City of St. Louis Park. 3. The proposed plat is situated upon the following described lands in Hennepin County, Minnesota, to -wit: That part of the abandoned right-of-way of the Great Northern Railway Company in Government Lot 2, Section 31, Township 29, Range 24, lying West of an extension across said right-of-way of the West line of Hampton Avenue as the latter appears on the plat of Cedarhurst and east of the east line of Lot 10, Block 4, Cedarhurst, extended southerly. Subject to a reservation by the State of Minnesota of mineral and mineral rights; That part of the Northwest Quarter of the Southeast Quarter and that part of Government Lot 2, Section 31, Township 29, Range 24, all described as commencing at the Southwest corner of said Northwest Quarter of the Southeast Quarter; thence on an assumed bearing of East along the South line of said Northwest Quarter of the Southeast Quarter a distance of 1317.2 feet; thence North 00 degrees, 04 minutes East a distance of 27.5 feet to the actual point of beginning; thence North 00 degrees 04 minutes East to the Southerly line of the abandoned railroad right-of-way in said Government Lot 2 and in said Northwest Quarter of the Southeast Quarter; thence Easterly along said Southerly right-of-way line to its intersection with the Southerly extension of the East line of Block 4, "Cedarhurst", thence Southerly along the extension of said East line to the North line of the South 27.5 feet of said Government Lot 2; thence West along said North line and its extension to the actual point of beginning, according to the Government Survey thereof. Conclusion 1. The proposed final plat of Silverberg Addition is hereby approved and accepted by the City as being in accord and conformity with all ordinances, City plans and regulations of the City of St. Louis Park and the laws of the State of Minnesota, subject to the following conditions: a. All utilities installed within the subdivision be constructed underground. b. A 10 -foot front setback variance is hereby granted to Lot 3 only, which will allow for a 25 -foot front yard instead of the required 35 -foot setback. provided, however, that this approval is made subject to opinion of the City Attorney and Certification by the City Clerk as provided for in Sections 14-303(3)(d) and (e) of the St. Louis Park Ordinance Code. 2. The City Clerk is hereby directed to supply two certified copies of this Resolution to the above-named owner and subdivider, who is the applicant herein. 3. The Mayor and City Manager are hereby authorized to execute all contracts required herein, and the City Clerk is hereby directed to execute the certificate of approval on behalf of the City Council upon the said plat when all of the conditions set forth in Paragraph No. 1 above and Section 14-303(3)(e) of the St. Louis Park Ordinance Code have been fulfilled. 4. Such execution of the certificate upon said plat by the City Clerk, as required under Section 14-303(3)(e), shall be conclusive showing of proper compliance therewith by the subdivider and City officials charged with duties above-described and shall entitle such plat to be placed on record forthwith without further formality. _Adopted_by_the City Council October 3, 1988 Reviewed for administration: Ii) i\i-a4/, Approved as to form and execution:
