HomeMy WebLinkAbout88-144 - ADMIN Resolution - City Council - 1988/10/031 1 i RESOLUTION NO. 88-144 A RESOLUTION OF FINDINGS REGARDING THE APPLICATION OF J. D. INTERNATIONAL INC. TO CHANGE THE LAND USE AND LANDSCAPE PLAN FOR PROPERTY ZONED PUD, LOCATED AT 2925 MONTEREY AVENUE. BE IT RESOLVED BY THE CITY OF ST. LOUIS PARK: 1. On August 4, 1988, J. D. International Inc. filed an application to amend the zoning ordinance to change the designated uses from townhouses (20 units) and elderly housing (senior citizen housing) (36 units) to townhouses (20 units) and conventional apartment units (36 units); and to change the Landscape Plan for property zoned PUD and located at 2925 Monterey Avenue to wit: Lot 1, Block 1, Daystar Addition, except that part thereof lying South of a line which extends to the East line of Block 1 and is drawn parallel with and a distant seven feet North from the North line of Lot 2, in said Block 1, and East of the Northerly extension of the West line of said Lot 2 2. On August 17, 1988, the Planning Commission reviewed the request and recommended approval of the zoning change on a vote of 6-0. 3. On September 19, 1988, the City Council held a public hearing, received testimony from the public, discussed the application and authorized preparation of a resolution of denial on a 4-1 vote. 4. Based on the testimony, evidence presented, files and records, and the staff reports at the time of the original request for approval dated May 6, 1985, Case No. 85-25-2, and the subject request dated August 4, 1988, which are hereby incorporated by reference, the City Council makes the following findings: a) The City Council took into account applicant's proposal and the Planning Commission's record regarding the case and impact related to senior citizen housing at the time of the original approval. b) The requested modification in the land use from elderly housing to conventional apartments is inconsistent with the adopted zoning and the basis for the original approval. c) The amount of traffic generated by senior citizen housing is estimated to be less than half the traffic generated by conventional units. d) The amount of off-street parking required to meet the needs for senior citizen housing is about half the amount required for conventional housing. e) The use allowed in the existing PUD zoning permits a reasonable use of the property. 4. Cont. f) There is no evidence to suggest that the existing uses allowed in the PUD zoning are improper or incorrect. g) There is no evidence to suggest that there was an error made when the PUD uses were established. CONCLUSION That portion of the application to change the land use from townhouses (20 units) and elderly housing (senior citizen housing) (36 units) to townhouses (20 units) and conventional apartment units (36 units) for property zoned PUD and located at 2925 Monterey Avenue, is hereby denied based upon the findings set forth above and on the ground that conditions for approval do not exist. That portion of the request to change the Landscape Plan is reasonable.
