RESOLUTION NO. 88-133
A RESOLUTION GRANTING SPECIAL (CONDITIONAL USE) PERMIT UNDER
SECTION OF THE ST. LOUIS PARK ORDINANCE CODE RELATING TO ZONING
TO PERMIT THE DEVELOPMENT OF A PARKING LOT FOR PROPERTY ZONED
B-2 GENERAL BUSINESS DISTRICT AND R-2 SINGLE FAMILY DISTRICT LOCATED
AT 4015 XENWOOD AVENUE
BE IT RESOLVED BY the City Council of the City of St. Louis Park:
Findings
1. Frank Lundberg, Post 282, St. Louis Park American Legion has made application
to the City Council for a special permit under Section 14-126 (4) of the,St. Louis Park
Ordinance Code for the purpose of the development of a parking lot within a B-2 General
Business District and R-2 Single Family District located at 4015 Xenwood Avenue for the
legal description as follows, to -wit:
Portions of Lots 35, 36, 37, and 39 Block 2, Suburban Homes Co. Addition
2. The City Council has considered the advice and recommendation of the Planning
Commission (Case No. 88 -64 -SP) and the effect of the proposed development of a parking
lot on the health, safety and welfare of the occupants of the surrounding lands, existing
and anticipated traffic conditions, the effect on values of properties in the surrounding
area, the effect of the use on the Comprehensive Plan, and compliance with the intent of
the Zoning Ordinance.
3. The Council has determined that the proposed parking lot will not be detrimental
to the health, safety, or general welfare of the community nor will it cause serious traffic
congestion nor hazards, nor will it seriously depreciate surrounding property values, and
the proposed parking lot is in harmony with the general purpose and intent of the Zoning
Ordinance and the Comprehensive Plan.
Conclusion
The special permit to permit the development of a parking lot at the location described
is granted based on the findings set forth above and subject to the following conditions:
1. The site shall be developed, used, and maintained in accordance with Exhibit A, East
Parking Lot Addition as modified by the following:
a. Xenwood Avenue north of 40 1/2 Street shall be vacated subject to the retention
of any necessary utility or access easements.
b. The future parking lot reconfiguration as shown on the plan be completed.
c. Poured -in-place concrete curbing measuring at least six inches above and below
the grade shall be installed around the perimeter of the parking lot with provision
made to accommodate sheet drainage.
d. A landscaping plan for that portion of the right-of-way of Xenwood Avenue , to
be vacated which will not be utilized for parking or sidewalks shall be submitted
by February 17, 1989. The temporary barrier on Xenwood Avenue shall be
extended westward to the east edge of the existing sidewalk and shall be in
place immediately upon completion of the parking lot facility, or by May 31,
1989, whichever comes first. Any parking lot lighting shall be installed such
that light rays are directed perpendicularly to the ground and shall not be directly
visible beyond the property lines.
2. Prior to construction of the parking lot the applicant shall enter into an agreement
with the City concerning the private use of a public right-of-way. Such agreement
shall terminate upon vacation of that portion of Xenwood Avenue north of 40 1/2
Street, but in no instance shall the agreement terminate at a date later than October
15, 1989.
3. All conditions of this special permit shall be completed and all improvements installed
by October 15, 1989.
