A RESOLUTION RESCINDING RESOLUTION NO. 5081 ADOPTED ON JULY
1, 1974, AND GRANTING SPECIAL (CONDITIONAL USE) PERMIT UNDER
SECTION 14-136 OF THE ST. LOUIS PARK ORDINANCE CODE
RELATING TO ZONING TO ALLOW THE CONSTRUCTION OF A PARKING
LOT AT 2400 NEVADA AVENUE
FINDINGS
WHEREAS, the Housing and Redevelopment Authority of St. Louis Park, Minnesota
has made application to the City Council for a special permit under Section 14-136 of
the St. Louis Park Ordinance Code to allow the construction of a parking lot at 2400
Nevada Avenue within a R-3, Multiple Family Residence District District having the
following legal description:
Lot 11, Home Addition, the northwest corner of Cedar Lake Road and
Nevada Avenue (Abstract)
WHEREAS, the City Council has considered the advice and recommendation of the
Planning Commission (Case No. 88 -65 -SP) and the effect of the proposed parking lot on
the health, safety, and welfare of the occupants of the surrounding lands, existing and
anticipated traffic conditions, the effect on values of properties in the surrounding area
and the effect of the use on the Comprehensive Plan; and
WHEREAS, a special permit was issued regarding the subject property pursuant to
Resolution No. 5081 of the St. Louis Park City Council dated July 1, 1974 which contained
conditions applicable to said property; and
WHEREAS, due to changed circumstances, amendments to those conditions are now
necessary, requiring the amendment of that special permit; and
WHEREAS, it is the intent of this resolution to continue and restate the conditions
of the permit granted by Resolution No. 5081 to add the amendments now required, and
to consolidate all conditions applicable to the subject property in this resolution;
CONCLUSION
NOW THEREFORE BE IT RESOLVED that Resolution No._50811filed Rsii um.eatlio,
5081 is hereby rescinded and replaced by this resolution which continues and amends a
special permit to the subject property for the purposes of permitting parking lot within the
R-3, Multiple Family Residence District District at the location described above based on
the following conditions:
1. That the site be developed, used, and maintained in accordance with Exhibit "A,"
Site Plan; Exhibit "B," Roof Plan and Landscape Plan; Exhibit "C," First Floor Plan;
Exhibit "D," Second Floor Plan; Exhibit "E," Third Floor Plan, Exhibit "F," Fourth
Floor Plan, Exhibit "G," Unit Plans south court elevation, and north court elevation;
except that the walkway shall not be chained or closed as shown on Exhibit "A," and
that the walkway be extended to the west property line; Exhibit "H," east elevation,
south elevation, west elevation and north elevation.
2. That all building construction; grading; parking lot construction, curbing, paving and
striping; landscaping and paved pathways, courtyard patios; retaining walls; sidewalks;
screening of rooftop equipment; and outside community areas (decks); be completed
by August 1, 1975.
3. That a fire hydrant be installed on the south side of Cedar Lake Road near the west
lot line of Lot 9, Home Addition by October 1, 1974.
4. That a drainage plan be submitted to and approved by the City Engineer before a
building permit is granted.
5. The parking lot on the north side of the building may be expanded as shown on
Exhibit Al, Site Plan. Said exhibit is applicable to the expansion of the parking lot
and adjacent landscape area only and if said improvements are made, the work shall
be completed by June 15, 1989.
