LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO PERMIT A CAR WASH WITH GASOLINE SALES FOR PROPERTY ZONED B-2, GENERAL BUSINESS DISTRICT, AND F-2, FLOODPLAIN DISTRICT LOCATED AT 8650 HIGHWAY 7 BE IT RESOLVED BY the City Council of the City of St. Louis Park: Findings 1. Page Three Incorporated (Arthur M. Lohmann, Trustee of the Koehler Family Trust) has made application to the City Council for a special permit under Section 14- 156(5) and 14-123.100(2) of the St. Louis Park Ordinance Code for the purpose of to permit a car wash within a B-2, General Business District, and F-2, Floodplain District located at 8650 Highway 7 for the legal description as follows, to -wit: That part of Tract X, Registered Land Survey No. 1058, Files of Registrar of Titles, County of Hennepin, lying Westerly of a line erected perpendicular to the Northerly line of said Tract X from a point thereon distant 268.76 feet Westerly from the most Northerly corner of said Tract X, as measured along said Northerly line, except the Easterly 130 feet thereof, and except that part thereof which lies Westerly of the following described line: Commencing at the Northwest corner of said Tract X; thence on an assumed bearing of North 79 degrees 08 minutes 30 seconds East along the Northerly line of said Tract X, a distance of 25.00 feet to the point of b ginni g of the line to be described; thence South 25 degrees 57 minutes 15 seconds West to the Westerly line of said Tract X and there terminating. (Torrens Certificate No. 682715) 2. The City Council has considered the advice and recommendation of the Planning Commission (Case No. 88 -62 -SP) and the effect of the proposed car wash on the health, safety and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area, the effect of the use on the Comprehensive Plan, and compliance with the intent of the Zoning Ordinance. 3. The Council has determined that the car wash will not be detrimental to the health, safety, or general welfare of the community nor will it cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding property values, and the proposed car wash is in harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan. Conclusion The special permit to permit a car wash with gasoline sales at the location described is granted based on the findings set forth above and subject to the following conditions: 1. The site shall be developed, used and maintained in accordance with Exhibit A, Site Plan; Exhibit B, Elevations; Exhibit C, Grading & Utility Plan; and Exhibit D, Landscape Plan subject to modification as follows: a. The landscaped setback at the south end of the employees' parking lot shall comply with setback requirement of 20 feet. b. Prior to issuance of the building permit, data sufficient to evaluate the structural integrity of the retaining walls shall be submitted along with proposed measures for providing a vehicular barrier on the top of such walls. c. The exterior materials of the building shall comply with the Architectural Control Ordinance and the Architectural Policy for the Knollwood Area. d. All trash and trash containers shall be stored indoors. e. All improvements shall be completed by March 30, 1989.
