RESOLUTION NO. 88-118
RESOLUTION GIVING APPROVAL FOR FINAL PLAT OF
DIAMOND HILL
BE IT RESOLVED BY the City Council of St. Louis Park:
Findings
1. Diamond Hill Center Partnership, owners and subdividers of the land proposed
to be platted as Diamond Hill have submitted an application for approval of final plat of
said subdivision in the manner required for platting of land under the St. Louis Park
Ordinance Code, and all proceedings have been duly had thereunder.
2. The proposed final plat has been found to be in all respects consistent with
the City Plan and the regulations and requirements of the laws of the State of Minnesota
and the ordinances of the City of St. Louis Park.
3. The proposed plat is situated upon the following described lands in Hennepin
County, Minnesota, to -wit:
The South 70.82 feet of Lot 8, Block 1, Fern Hill, St. Louis Park, Minn.,
according the recorded plat thereof, and situate in Hennepin County, Minnesota.
Lots 10 and 11, Block 2, together with that part of the adjacent vacated alley
accruing thereto by reason of the vacation, Manhattan Park First Addition,
St. Louis Park, according to the recorded plat thereof, and situate in Hennepin
County, Minnesota.
Lots 12 and 13, Block 2, Manhattan Park First Addition to St. Louis Park,
together with the west 1/2 of vacated alley adjoining said lots and together
with all that part of Joppa Avenue vacated adjoining said lots, according to
the plat thereof on file and of record in the office of the Register of Deeds,
in and for Hennepin County, Minnesota.
That part of the East 1/2 of the East 1/2 of the Northwest 1/4 of the Northeast
1/4 of Section 6, Township 28, Range 24, lying South of State Trunk Highway
No. 7, as now laid out and opened, and North of the right-of-way of the
Minneapolis & St. Louis Railway Company, according to the United States
Government Survey, and situate in Hennepin County, Minnesota.
Lot 9, Block 1, in "Fern Hill", St. Louis Park, Minnesota, according to the plat
thereof on file and of record in the office of the Register of Deeds, in and
for Hennepin County, Minnesota.
That part of Lot 4, "Auditor's Subdivision Number 267, Hennepin County,
Minnesota", described as follows: Lots 14 and 15, Block 2, Manhattan Park
First Addition, St. Louis Park, including the Westerly 1/2 of the vacated alley
lying Easterly of and immediately adjacent to said lots, excepting that part of
the above mentioned Lot 15 and of said vacated alley described as follows:
Beginning at a point in the Southerly line of said Block 2, Manhattan Park
First Addition, St. Louis Park, distant 23.22 feet Easterly measured along the
Southerly line of said Block 2 from the Southwesterly corner thereof, thence
Easterly along the Southerly line of said Block 2 to an intersection with the
center line of said above mentioned vacated alley: Thence Northerly along
the center line of said vacated alley 30.86 feet thence Southwesterly in a
straight line to the point of beginning.
And that portion of the East 1/2 Joppa Avenue lying between the South line
of "Manhattan Park First Addition St. Louis Park" and an extension Westward
of the North line of said Lot 4, according to the plat thereof on file and of
record in the office of the Registrar of Titles in and for Hennepin County,
Minnesota. 1
That part of Joppa Avenue acquired by Deed Document No. 2833064 and 2833065
and now to be vacated which lies southerly of the westerly extension of the
north line of Lot 10, Block 7, Manhattan Park First Addition to St. Louis Park.
Conclusion
1. The proposed final plat of Diamond Hill is hereby approved and accepted by
the City as being in accord and conformity with all ordinances, City plans and regulations
of the City of St. Louis Park and the laws of the State of Minnesota, subject to the
following conditions:
a. The subdivider shall convey to the City an easement for public right-of-way
purposes over and across that part of the following described properties:

That part of the East 1/2 of the East 1/2 of the Northwest
1/4 of the Northeast 1/4 of Section 6, Township 28,
Range 24, lying South of State Trunk Highway No. 7, as
now laid out and opened, and North of the right-of-way
of the Minneapolis & St. Louis Railway Company,
according to the United States Government Survey, and
situate in Hennepin County, Minnesota.
Lots 10 and 11, Block 2, "MANHATTAN PARK FIRST
ADDITION ST. LOUIS PARK", according to the recorded
plat thereof, and vacated Joppa Avenue.
Which lies within the circumference of a circle having a radius of 50.00 feet.
The center of said circle is a point on the east line of the Northwest Quarter
of the Northeast Quarter of said Section 6 distant 50.00 feet southwesterly
from the northwest corner of said Lot 10.
Said easement shall be conveyed to the City prior to signature of the plat by
the City Clerk.
b. The two single family houses on the subject property shall be moved or
demolished prior to signature of the plat by the City Clerk.
provided, however, that this approval is made subject to opinion of the City Attorney
and Certification by the City Clerk as provided for in Sections 14-303(3)(d) and (e) of the
St. Louis Park Ordinance Code.
2. The City notes the existence of a minor encroachment of the neighboring
building across the westerly property line of the plat. The City's approval of this plat is
in no way to be construed as an approval of said encroachment nor does it have any effect
on the titles of either the property being platted or the adjoining property upon which
the encroaching building is situated.
3. The City Clerk is hereby directed to supply two certified copies of this
Resolution to the above-named owner and subdivider, who is the applicant herein.
4. The Mayor and City Manager are hereby authorized to execute all contracts
required herein, and the City Clerk is hereby directed to execute the certificate of
approval on behalf of the City Council upon the said plat when all of the conditions set
forth in Paragraph No. 1 above and Section 14-303(3)(e) of the St. Louis Park Ordinance
Code have been fulfilled.
5. Such execution of the certificate upon said plat by the City Clerk, as required
under Section 14-303(3)(e), shall be conclusive showing of proper compliance therewith by
the subdivider and City officials charged with duties above-described and shall entitle
such plat to be placed on record forthwith without further formality.
