HomeMy WebLinkAbout88-34 - ADMIN Resolution - City Council - 1988/03/07110 RESOLUTION NO. 85-34 A RESOLUTION RESCINDING RESOLUTION NO. 87-86 ADOPTED ON JULY 20, 1987, RESCINDING RESOLUTION NO. 86-77 ADOPTED ON JUNE 16, 1986, AND GRANTING SPECIAL (CONDITIONAL USE) PERMIT UNDER SECTION 14-123.100(2) OF THE ST. LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO PERMIT THE PLACEMENT OF FILL IN THE FLOOD PLAIN FOR PROPERTY ZONED 1-1, INDUSTRIAL DISTRICT, AND F-2, FLOODPLAIN DISTRICT, LOCATED AT 6950 OXFORD STREET FINDINGS WHEREAS, J & F Reddy Rents Inc. (St. Louis Home Association of Knights of Columbus 3949) has made application to the City Council for a special permit under Section 14- 123.100(2) of the St. Louis Park Ordinance Code to permit the placement of fill in the flood plain at 6950 Oxford Street within an I-1, Industrial District, and F-2, Floodplain District having the following legal description: Lot 2, Block 1, Otterlei Addition WHEREAS, the City Council has considered the advice and recommendation of the Planning Commission (Case Nos. 83 -76 -SP and 87 -49 -SP) and the effect of the proposed placement of fill in the flood plain on the health, safety, and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area and the effect of the use on the Comprehensive Plan; and WHEREAS, a special permit was issued for an open storage yard on the subleet property pursuant to Resolution No. 86-77 of the St. Louis Park City Council dated June 16, 1986, which contained conditions applicable to said property; however, the open storage yard was not established and the special permit expired; and WHEREAS, a new special permit was issued to allow the placement of fill in the floodplain pursuant to Resolution No. 87-86 of the St. Louis Park City Council dated July 20, 1987; and WHEREAS, the applicant has submitted revised exhibits requiring the amendment of the special permit granted by Resolution No. 87-86; and WHEREAS, it is the intent of this resolution to continue and restate the conditions of the permit granted by Resolution No. 87-86, to add the amendments now required, and to consolidate all conditions applicable to the subject propety in this resolution; CONCLUSION NOW THEREFORE BE IT RESOLVED that Resolution No. 87-86 (filed as Document No. 1862706) is hereby rescinded and replaced by this resolution which permits the placement of fill in the flood plain within the 1-1, Industrial District, and F-2, Floodplain District at the location described above based on the following conditions: 1. The site shall be developed, used and maintained in accordance with Exhibit A1 - Site Plan, Exhibit B1 - Grading and Drainage Plan; Exhibit C1, Sheets 1 and 2 - Floor Plan, and Exhibit D1 - Elevations; subject to the following: a. Approval of the request is contingent_ upon a showing by the applicant that the design of the retaining wall along the westerly property line is such as to guarantee the structural integrity of said retaining wall. b. The parking lot shall be bordered by a 6 -inch, poured -in-place concrete curb, except along the retaining wall on the west side of the parking lot. c. The applicant agrees to maintain the water runoff detention areas to prevent the accumulation of salt and debris in these areas. d. All trash storage outside shall be handled only in the trash enclosure designated on the exhibit. e. No lights shall be more than 20 feet above the ground and all light rays shall be directed perpendicularly to the ground. f. All improvements on the site including, but not limited to, filling, grading and drainage, wall construction, building and parking lot, shall be accomplished and maintained in a manner so as not to adversely affect abutting property. g.
