HomeMy WebLinkAbout88-135 - ADMIN Resolution - City Council - 1988/09/191 1 i 9/15/88 RESOLUTION 135-88 RESOLUTION REORGANIZING THE HOUSING AND REDEVELOPMENT AUTHORITY OF SAINT LOUIS PARK, MINNESOTA WHEREAS, pursuant -to Resolution No. 3923 adopted by the City Council of the City of Saint Louis Park on March 16, 1970, the City Council declared the need for a Housing and Redevelopment Authority in the City of Saint Louis Park; and WHEREAS, by Resolution No. 4005 the City Council of the City of Saint Louis Park appointed the first Board of Commissioners of the Housing and Redevelopment Authority of Saint Louis Park, Minnesota; and WHEREAS, the Housing and Redevelopment Authority of Saint Louis Park, Minnesota on October 27, 1970 organized itself by its Resolution No. 1 and adopted bylaws governing its operations in its Resolution No. 2; and WHEREAS, the City Council has pursuant to Minnesota Statutes Sections 469.090 et seq. established by Resolution No. 134-88and Ordinance No. 1763-88an Economic Development Aii.thorlt.y for --the purpose of conducting various economic development, housing and redevelopment programs and activities within the City of Saint Louis Park; and WHEREAS, the City has determined that it is in the public interest to vest in the Economic Development Authority -certain powers, duties and obligations presently held by the Housing and Redevelopment Authority of the City of Saint Louis Park; and WHEREAS, the City Council desires to reorganize the Housing and Redevelopment Authority of the City of Saint Louis Park, rename it the "Housing Authority", and clarify the scope of its duties and responsibilities; NOW THEREFORE, BE IT RESOLVED by the City of Saint Louis Park, Minnesota as follows: Section 1. The Housing Authority, created by Resolution of the City Council No. 3923 dated March 16, 1970, shall hereafter discharge the following responsibilities: (a) The Housing Authority shall manage existing and future low and moderate income housing programs owned or operated by it within the City of Saint Louis Park; (b) The Housing Authority shall plan and implement housing programs primarily involving low and moderate income persons within the City; (c) The_.Housing_Au_thoxi_ty-shatl--have the power to -accept control and authority over any housing project or program for low and moderate income persons which the Economic Development Authority delegates to the Housing Authority. (d) The Housing Authority may levy special benefit taxes as authorized by law in furtherance of housing projects and programs for low and moderate income persons and those housing projects transferred to the Housing Authority from the Economic Development Authority, subject to prior approval of the City Council. -2- 1 1 11 Section 2. The City Council shall by separate resolution transfer certain assets and liabilities of the Housing Authority to the Economic Development Authority consistent with the terms of this Resolution, Ordinance No. 1763-88 , and Resolution No. 134-88. Section 3. The Housing Authority shall make such modifications in its organizational documents and its bylaws as are required to implement the provisions of this resolution. The City Manager, or his designee, shall be the Executive Director of the Housing Authority. The Authority shall utilize City personnel to conduct its business except that it may retain consultants or independent contracts if City personnel do not have the necessary expertise or resources, in the judgment of its Executive Director. Section 4. The Housing Authority, as reorganized by this resolution, may exercise all of the powers granted under Minnesota Statutes Section 469.001 to 469.047 for the purpose of managing, planning and implementing the City's low and_modex_a.teJncc.me housing programs as provided in this Resolution; provided, however, that all such powers shall be exercised solely to effectuate the powers of the HRA as reorganized and modified by this Resolution and Ordinance No. 1763-88 Section 5. Resolutions No. 3923 and 4005 are hereby repealed and replaced by this Resolution. The Housing Authority is a reorganized continuation of the Housing and Redevelopment Authority. Section 6. The definition of terms under this Resolution shall include, but not be limited to, the definitions provided in Minnesota Statutes Sections 469.001 et seq and Ordinance No. 1763.88 1988. Section 7.
