HomeMy WebLinkAbout87-91 - ADMIN Resolution - City Council - 1987/07/20RESOLUTION N0. 87-91 RESOLUTION CONFIRMING AND REAFFIRMING THE POSITION OF FIRE MARSHAL IN THE FIRE DEPARTMENT WHEREAS, the fire management study completed in March 1986 recommended giving the Fire Marshal position the status of an Assistant Fire Chief reporting directly to the Fire Chief but retaining the title of Fire Marshal; and WHEREAS, the September 10, 1986 memo from the City Manager recommended that the Fire Marshal position be listed in the 1987 budget with the status of an Assistant Fire Chief reporting to the Fire Chief, but that consideration be given to retaining the title of Fire Marshal; and_ WHEREAS, the 1987 budget adopted on October 20, 1986 provided for giving the Fire Marshal the status of Assistant Fire Chief and appropriated the funds for making the salary for this position identical to the salary for the then existing Assistant Fire Chief position; and WHEREAS, pursuant to City Council action, the Fire Civil Service Commission on October 22, 1986 amended its rules to provide for fire prevention duties to be carried out by an Assistant Fire Chief/Fire Prevention Officer and established the recruiting process for this position; and WHEREAS, the Fire Civil Service Commission certified the list of eligible candidates for Assistant Fire Chief/Fire Prevention Officer on December 4, 1986; and WHEREAS, Michael Stockstead and the International Association of Firefighters, Local 993, brought a lawsuit challenging the validity of the Fire Civil Service Commission rules and regulations, the manner in which the Assistant Fire Chief/Fire Prevention Officer position was created and the selection process established on October 22, 1986; and WHEREAS, the court ruled on June 5, 1987 that the Fire Civil Service Commission acted invalidly in amending its rules and regulations on October 22, 1986 in creating the position of Assistant Fire Chief/Fire Prevention Officer, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of St. Louis Park, that: 1. The position of Fire Marshal be confirmed and reaffirmed and given ,the status of Assistant Fire Chief; 2. The Fire Civil Service Commission be requested to bring its rules and regulations into conformance with the June 5, 1987 court order; and 3. The Fire Civil Service Commission be requested to take appropriate action to fill the Fire Marshal position when the position is requisitioned by the City Manager.
