(c?7-441 RESOLUTION NO. 87-8 A RESOLUTION GRANTING SPECIAL (CONDITIONAL USE) PERMIT UNDER SECTIONS 14-123.100 AND 14-171(5.1) OF THE ST. LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO PERMIT FILLING IN THE FLOOD PLAIN AND TO ESTABLISH A FISH AND SEAFOOD PROCESSING FACILITY, ON PROPERTY ZONED I-1, INDUSTRIAL AND F-2, FLOOD PLAIN LOCATED AT 7201 WEST LAKE STREET BE IT RESOLVED BY the City Council of the City of St. Louis Park: Findings 1. Richatti Investment Corporation (Adelyn L. Luther) has made application to the City Council for a special permit under Sections 14-123.100 and 14-171(5.1) of the St. Louis Park Ordinance Code for the purpose of filling in the flood plain and the establishment of a fish and seafood processing facility within a 1-1, Industrial District, and F-2, Flood Plain District located at 7201 West Lake Street for the legal description as follows, to -wit: Parcel 1: That part of Lots 1 - 6 inclusive, Block 160, Rearrangement of St. Louis Park, including one-half of adjoining vacated Rex Avenue except that part of said Lot 1 lying northeasterly of a line drawn from a point in the easterly line of said Lot 1 with the intersection of the southerly right-of-way line of the railroad right-of-way; thence northwesterly to a point in the northwesterly line of said Lot 1, 50 feet westerly as measured along the northwesterly line from the most northerly corner of said Lot 1 which lies northwesterly of Irwin Mandel - Neil Boderman Addition. Parcel 2: That part of Lots 1 to 10 inclusive, Block 161, Rearrangement of St. Louis Park, including adjoining Rex Avenue which lies northeasterly of the following described line: Commencing at the most westerly corner of Lot 1, Block 1, Irwin Mandel - Neil Boderman Addition; thence northwesterly parallel to the centerline of said vacated Rex Avenue to the southerly right- of-way line of the railroad right-of-way; thence northerly to the most northerly corner of said Lot 1 Parcel 3: Lot 1, Block 1, Irwin Mandel - Neil Boderman Addition (Abstract and Torrens Certificate No. 420957) 2. The City Council has considered the advice and recommendation of the Plannin� Commission (Case No. 86 -97 -SP) and the effect of filling in the flood plain and the establishment of fish and seafood processing facility on the health, safety and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area, the effect of the use on the Comprehensive Plan, and compliance with the intent, of the Zoning Ordinance. 3. The Council has determined that filling in the flood plain and the establishment of a fish and seafood processing facility will not be detrimental to the health, safety, or general welfare of the community nor will it cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding property values, and the proposed fish processing facility is in harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan. Conclusion The special permit to permit filling in the flood plain and the establishment of a fish and seafood processing facility at the location described is granted based on the findings set forth above and subject to the following conditions: 1. That the site be developed, used and maintained in accordance with Exhibit A - Site and Landscape Plan; Exhibit B - Elevations; and Exhibit C - Grading and Drainage Plan, as modified on January 20, 1987, and as modified by the following conditions: 2. Prior to issuance of a building permit, the applicant must provide detailed plans for inside handling and storage of all forms of trash and waste materials generated from the use of the site and the processing of fish which are or contain organic materials or substances from fish and seafood processing. 3. That all trash be stored within the building, and there shall be no outside storage of trash or trash containers except that a trash compactor attached to the building and aesthetically screened on the remaining three sides shall be permitted for storage of cartage, paper and similar non-organic material but not including organic materials or substances from the fish and seafood processing. There shall be no other outdoor storage of supplies, goods or materials. 4. That all parking lot areas be delineated by poured -in-place concrete curbing measuring at least six inches above and below grade. 5. That all outdoor lighting, other than globe lighting, shall be directed perpendicular to the ground. 6. The applicant and owner hereby acknowledge that the subject property and abutting area are subject to the subwatershed drainage area study (MC -19) which provides a plan for detenion and storage of flood water thereby allowing fill and development of the subject property located in a F-2, Flood Plain District. The applicant and property owner further acknowledge their agreement to execute an agreement with the City (as prepared and approved by the City attorney) to cover the cost allocated to the subject property and to post the cash amount, letter of credit, or other security as prescribed by said agreement. Failure to execute such agreement within 30 days after submssion shall invalidate this special permit resulting in it being automatically canceled and rescinded. Said agreement must, however, be executed prior to grading or filling on the site and prior to issuance of a building permit to construct any of the improvements described in this resolution as shown on the exhibits. 7. That all improvements including landscaping, parking lot surfacing, striping, curbing, and other elements shown on the exhibits be completed by October 15, 1987. 8. This special permit shall be effective upon the effective date of Ordinance No. 1708- 87, which amends Section 14-171 of the St. Louis Park Ordinance Code to include fish and seafood processing as a special permit use in the I-1 District.
