A RESOLUTION RESCINDING RESOLUTION NO. 7320 ADOPTED ON
JANUARY 17, 1983, AND GRANTING A FIVE YEAR SPECIAL
(CONDITIONAL USE) PERMIT UNDER SECTION 14-156(18) OF THE ST.
LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO ALLOW
AN AUTOMOTIVE SERVICE CENTER FOR PROERTY LOCATED IN THE
B-2, BUSINESS DISTRICT, AT 5125 MINNETONKA BOULEVARD
FINDINGS
WHEREAS, MOTEC Industries Inc. (David Borneman and Equity Construction Company)
has made application to the City Council for a special permit under Section 14-156(18) of
the St. Louis Park Ordinance Code to allow an automotive service center at 5125
Minnetonka Boulevard within a B-2, Business District having the following legal description:
Lot 1, in Auditors Subdivision No. 53, except the South 54 feet
WHEREAS, the City Council has considered the advice and recommendation of the
Planning Commission (Case No. 82 -94 -SP and 86 -91 -SP) and the effect of the proposed
automotive service center on the health, safety, and welfare of the occupants of the
surrounding lands, existing and anticipated traffic conditions, the effect on values of
properties in the surrounding area and the effect of the use on the Comprehensive Plan; and
WHEREAS, a special permit was issued regarding the subject property pursuant to
Resolution No. 7320 of the St. Louis Park City Council dated January 17, 1983, which
contained conditions applicable to said property; and
WHEREAS, due to changed circumstances, amendments to those conditions are now
necessary, requiring the amendment of that special permit; and
WHEREAS, it is the intent of this resolution to continue and restate the conditions
of the permit granted by Resolution No. 7320 to add the amendments now required, and
to consolidate all conditions applicable to the subject property in this resolution;
CONCLUSION
NOW THEREFORE BE IT RESOLVED that Resolution No. 7320 (filed as Document No.
4780782) is hereby rescinded and replaced by this resolution which continues and amends
a special permit to the subject property for the purposes of permitting automotive service
center within the B-2, Business District at the location described above based on the
following conditions:
1. That the site be developed, used and maintained in accordance with Exhibit A - Site
Plan; Exhibit B - Floor Plan; Exhibit C - Elevation Plan, North, East and West; and
Exhibit D - Elevation Plan, South.
2. That a five foot wide sidewalk easement adjacent to Minnetonka Boulevard over the
north 5 feet of said Lot 1, Auditors Subdivision No. 53 except the south 54 feet be
granted by the applicant prior to issuance of a Certificate of Occupancy.
3. That all lighting be directed perpendicular to the ground and be shielded so that no
direct rays are visible beyond the property.
4. That landscaping improvements be made in accordance with Exhibit A.
5. That there be no change in the configuration of the slope on the south side of the
property and that existing trees be retained.
6. That there be no outdoor storage of trash or other materials at any time.
7. That the permit shall terminate on December 31, 1987.
8. That the exterior treatment of the building shall be allowed until December 31, 1987,
because of the termination date of the special permit.
9. That all improvements on the site be completed by May 14, 1983.
10. That site modifications be permitted as shown on Exhibit E - New Site Plan; and
Exhibit F - Free Standing Sign, subject to the following:
a. The free-standing sign shall be no higher than 25 feet and shall not be lighted
after 10:00 p.m. 1
b. Curbing shall be !installed along the south property line as shown on the plan,
and curbing shall be placed around the landscape island between the driveways
on Salem Avenue.
c. Curbing shall be poured -in-place concrete measuring at least 6" above and below
grade.
d. That vehicles from the subject property be prohibited from parking on the street.
e. All site improvements be completed by October 15, 1987.
f. That the use as approved and subject to all the special permit provisions be
extended to December 31, 1992, effective only if full compliance to the special
permit provisions is obtained by certification from Inspectional Services on or
before October 15, 1987, and provided full compliance continues thereafter. If
a certificate of compliance is obtained and there is a failure to comply after
October 15, 1987, this extension is also automatically void.
