HomeMy WebLinkAbout87-70 - ADMIN Resolution - City Council - 1987/06/15RESOLUTION NO. 87-70 A RESOLUTION RESCINDING RESOLUTION NO. 6467 ADOPTED ON JANUARY 7, 1980 AND RESCINDING RESOLUTION NO. 7390 ADOPTED ON MAY 16, 1983 (WHICH RESCINDED RESOLUTION NO. 7256 ADOPTED ON OCTOBER 4, 1982, WHICH AMENDED RESOLUTION NO. 5652 ADOPTED DECEMBER 20, 1976), AND GRANTING SPECIAL (CONDITIONAL USE) PERMIT UNDER SECTION 14-124.101 OF THE ST. LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO PERMIT AN OFF -SALE LIQUOR STORE AT 4600 EXCELSIOR BOULEVARD AND TWO CLASS I RESTAURANTS AT 4606-4630 EXCELSIOR BOULEVARD IN THE PUD, PLANNED UNIT DEVELOPMENT DISTRICT FINDINGS WHEREAS, Michael James Jennings has made application to the City Council for two special permits under Section 14-124.101 of the St. Louis Park Ordinance Code to allow a Class I restaurant at 4600 Excelsior Boulevard and for an off -sale liquor store and Class I restaurant at 4606-4630 Excelsior Boulevard, within a PUD, Planned Unit Development District having the following legal description: Lots 8 to 20 inclusive, Block 3, "Minikanda Vista 2nd Addition, Hennepin County" WHEREAS, the City Council has considered the advice and recommendation of the Planning Commission (Case Nos. 76 -89 -SP, 79 -101 -SP, 82 -68 -SP and 87 -43 -SP) and the effect of the Class I restaurants and off -sale liquor store on the health, safety, and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area and the effect of the use on the Comprehensive Plan; and WHEREAS, two special permits were issued regarding the subject properties pursuant to Resolution No. 6467 of the St. Louis Park City Council dated January 1, 1980 for 4600 Excelsior Boulevard, and Resolution No. 7390 of the St. Louis Park City Council dated May 16, 1983 for 4606-4630 Excelsior Boulevard, which contained conditions applicable to said properties; and WHEREAS, the applicant seeks to modify the two special permits approved for 4600 Excelsior Boulevard (Maggie's Pizza) and 4606-4630 Excelsior Boulevard (Jenning's Liquor, Jenning's Red Coach Inn _and Timothy O'Toole's Pub), and -to combine the plans -and special permits into a single proposal identified as Case No. 87 -43 -SP; and WHEREAS, due to the changed circumstances referenced above, amendments to those conditions are now necessary, requiring amendments of the two special permits; and WHEREAS, it is the intent of this resolution to continue and restate the conditions of the permits granted by Resolution Nos. 6467 and 7390, to add the amendments now required, and to consolidate all conditions applicable to the subject properties in this resolution;
