RESOLUTION NO. 87-67
A RESOLUTION GRANTING SPECIAL (CONDITIONAL USE) PERMIT UNDER
SECTION 14-123.100(2) OF THE ST. LOUIS PARK ORDINANCE CODE RELATING
TO ZONING TO PERMIT GRADING AND EXCAVATION OF MATERIAL IN
CONJUNCTION WITH THE EXPANSION OF A STORM WATER PONDING AREA
FOR PROPERTY ZONED I-1, INDUSTRIAL DISTRICT, AND F-2, FLOODPLAIN
DISTRICT LOCATED AT LAKE STREET AND LOUISIANA AVENUE
BE IT RESOLVED BY the City Council of the City of St. Louis Park:
Findings
1. The City of St. Louis Park has made application to the City Council for a special
permit under Section 14-123.100(2) of the St. Louis Park Ordinance Code for the purpose
of permitting grading and excavation of material in conjunction with the expansion of a
storm water ponding area within an I-1, Industrial District, and F-2, Floodplain District
located at Lake Street and Louisiana Avenue for the legal description as follows, to -wit:
Commencing at the intersection of the northwesterly line of Irwin Mandel/Neil
Boderman Addition with the southwesterly line of Lot 5, Block 160, Rearrangement
of St. Louis Park; thence on an assumed bearing of south 44 degrees 44 minutes
41 seconds west a distance of 136.6 feet to the actual point of beginning; thence
north 45 degrees 15 minutes 19 seconds west to the southerly right-of-way line
of the Chicago, Milwaukee, St. Paul and Pacific Railroad; thence northwesterly
to the most northeasterly corner of Lot 1, Block 161, Rearrangement of St. Louis
Park; thence southwesterly along the northwesterly line of said Lot 1 and its
southwesterly extension to a line drawn parallel with and 10 feet southwesterly
from the center line of spur track 1CC 260 of the Chicago, Milwaukee, St. Paul
and Pacific Railroad; thence southeasterly along said parallel line to the point
of curve to the right; thence continuing southeasterly parallel with the tangent
of said curve to the southeasterly line of the northwesterly 100 feet of Lot 16
of said Block 161, thence southwesterly along said southeasterly line to the
easterly line of Lot 17, Block 161, thence southerly along said easterly line and
its southerly extension to the centerline of vacated 2nd Street South; thence
northwesterly along said centerline to the south line of Edgebrook Drive; thence
westerly to the northwest corner of Lot 18, Block 57A, Rearrangement of St.
Louis Park; thence southeasterly to the most southerly corner thereof; thence
northeasterly to the most southerly corner of Irwin Mandel/Neil Boderman Addition;
thence northwesterly along the southwesterly line thereof to the most westerly
corner thereof; thence northeasterly to the point of beginning.
2. The City Council has considered the advice and recommendation of the Planning
Commission (Case No. 87 -38 -SP) and the effect of the proposed grading and excavation
of material on the health, safety and welfare of the occupants of the surrounding lands,
existing and anticipated traffic conditions, the effect on values of properties in the
surrounding area, the effect of the use on the Comprehensive Plan, and compliance with
the intent of the Zoning Ordinance.
3. The Council has determined that the grading and excavation of material will not be
detrimental to the health, safety, or general welfare of the community nor will it
cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding
property values, and the proposed grading and excavation of material is in harmony
with the general purpose and intent of the Zoning Ordinance and the Comprehensive
Plan.
Conclusion
The special permit to permit grading and excavation of material in conjunction with the
expansion of a storm water ponding area at the location described is granted based on
the findings set forth above and subject to the following conditions:
1. The site shall be developed, used and maintained in accordance with Exhibit A - South
Oak Pond Expansion, Excavation and Pond Liner Construction, with the understanding
that the north edge and Lake Street boulevard be planted with a variety of street
trees placed in clusters and as street trees.
2. All improvements shall be completed by October 15, 1987.
