LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO PERMIT A SERVICE STATION ON PROPERTY ZONED B-2, BUSINESS DISTRICT, LOCATED AT 6329 WEST LAKE STREET BE IT RESOLVED BY the City Council of the City of St. Louis Park: Findings 1. Jody A. Berg has made application to the City Council for a special permit under Section 14-156(15) of the St. Louis Park Ordinance Code for the purpose of permitting a service station within a B-2, Business District, located at 6329 West Lake Street for the legal description as follows, to -wit: Par 1: That part of Lot 5, Auditor's Subdivision Number 378, Hennepin County, Minnesota lying Southwesterly of a line drawn parallel to the Northeasterly line of said Lot 5 from a point on the Northwesterly line of said Lot 5, point distant 149.23 feet Northeasterly, as measured along said Northwesterly line, from the most Westerly corner of said Lot 5, according to the plat thereof on file or of record in the office of the Registrar of Titles in and for said County. Par 2: The West 16 feet of the following described tract: All that part of Lots 26, 27, 28, Block 11, Rearrangement of St. Louis Park described as follows: Beginning at the Southwest corner of Lot 26; thence Northerly along the Westerly line of said Lot 26, 56.6 feet; thence Northeasterly 70.3 feet more or less to the intersection with a line, which line is described as follows: Commencing at a point on the Southeasterly line of Lake Street distant 38 feet Southwesterly along said Southwesterly line from the Northeasterly corner of Lot 21, said Block 11 and running to a point on a line drawn parallel, with the Easterly line of Lot 28 from a point on the South line of said Lot 28, 9 feet Westerly along said South line from the Southeast corner thereof, said point being 90 feet North along said parallel line from the South line of said Lot 28; thence Southeasterly along the last above described line to a point 90 feet North of the south line of Lot 28; thence Southerly parallel to the Easterly line of said Lot 28 to the South line of said Lot; thence Westerly along the South line of Lots 28, 27, 26, 66 feet to the point of beginning, according to the plat thereof on file or of record in the office of the Register of Deeds in and for said County (Torrens Certificate No. 674881) 2. The City Council has considered the advice and recommendation of the Planning Commission (Case No. 87 -36 -SP) and the effect of the proposed service station on the health, safety and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area, the effect of the use on the Comprehensive Plan, and compliance with the intent of the Zoning Ordinance. 3. The Council has determined that the service station will not be detrimental to the health, safety, or general welfare of the community nor will it cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding property values, and the proposed service station is in harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan. Conclusion The special permit to permit a service station in a B-2, Business District, at the location described is granted based on the findings set forth above and subject to the following conditions: 1. That the site be developed, used and maintained in accordance with Exhibit A - Site and Elevation Plan as modified to show the extension of the sidewalk along 34th Street to Lake Street, moving the landscaping presently shown on the boulevard to the private property and the provision of four street trees on the boulevard adjacent to the site. Said boulevard trees shall be a minimum of 2 1/2 inches in diameter measured 1 foot off the ground at the time of planting. 2. All improvements including site modifications and landscaping, including boulevard trees and sidewalk, shall be completed by October 15, 1987.
