HomeMy WebLinkAbout87-53 - ADMIN Resolution - City Council - 1987/05/04RESOLUTION NO. 87-53 A RESOLUTION RESCINDING RESOLUTION NO. 7214 ADOPTED ON SEPTEMBER 7, 1982, AMENDING RESOLUTION NO. 7131 ADOPTED ON MAY 3, 1982, AMENDING RESOLUTION NO. 6193 ADOPTED ON DECEMBER 18, 1978, AND GRANTING SPECIAL (CONDITIONAL USE) PERMIT UNDER SECTION 14-124.101 OF THE ST. LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO ALLOW A 128 -UNIT CONDOMINIUM MULTIPLE FAMILY DEVELOPMENT FOR PROPERTY LOCATED IN THE PUD, PLANNED UNIT DEVELOPMENT DISTRICT, AT 3300-3320 LOUISIANA AVENUE SOUTH FINDINGS WHEREAS, C.M.I. Real Estate Development, Inc. and Thirty -Three Hundred On The Park Association have made application to the City Council for a special permit under Section 14-124.101 of the St. Louis Park Ordinance Code to allow the construction of a 128 -unit condominium building at 3300-3320 Louisiana Avenue South within a PUD, Planned Unit Development District having the following legal description: Lot 1, Block 4, Oak Park Village WHEREAS, the City Council has considered the advice and recommendation of the Planning Commission (Case No. 82 -24 -SP and 87 -25 -SP) and the effect of the proposed 128 -unit condominium building on the health, safety, and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area and the effect of the use on the Comprehensive Plan; and WHEREAS, a special permit was issued regarding the subject property pursuant to Resolution No. 7214 of the St. Louis Park City Council dated September 7, 1982 which contained conditions applicable to said property; and WHEREAS, due to changed circumstances, amendments to those conditions are now necessary, requiring the amendment of that special permit; and WHEREAS, it is the intent of this resolution to continue and restate the conditions of the permit granted by Resolution No. 7214 to add the amendments now required, and to consolidate all conditions applicable to the subject property in this resolution; CONCLUSION NOW THEREFORE BE IT RESOLVED that Resolution No. 7214 (Document not filed) is hereby rescinded and replaced by this resolution which continues and amends a special permit to the subject property for the purposes of permitting 128 -unit condominium building within the PUD, Planned Unit Development District at the location described above based on the following conditions: 1. That the site be developed, used and maintained in accordance with the Site Plan and Development Exhibits Al, A3, A4, A5, A6, A7, A8, A9, A10, All, A14, A15, A16, A17, A18, A19, A20, A22, A23, and A24, except that minor adjustments and interior wall locations, equipment and facilities may be made to meet code requirements as may be required to accommodate electrical, mechanical, structural and other requirements. 2. All improvements, including the building, landscaping, parking, access, outdoor amenities, curbing and paving, and all other items as shown on the exhibits shall be completed by June 15, 1980. 3. That the following design specifications be established for the purpose of enclosing balconies: All exterior framing must be anodized aluminum or solid hardwood colored or stained an earthtone brown to match the redwood brick exterior of the building. The existing guard rail must remain on the outside when not on the ground floor. All panels shall be of uniform width and length measuring 3 or 4 feet wide and 7 feet high with additional division breaking the 3 to 4 foot wide lengths into windows measuring approximately 38 inches wide by 26 inches high. These windows shall be placed within six inches of the outside edge of the balcony or patio. Where screen panels are provided, they must be the same length and width as the glass panels, and exterior materials and colors shall match those specified for the exterior framing. All such enclosures must meet the City's building codes and architectural code. 4. Condition No. 3 is hereby modified as follows: That the following design specifications be established for the purpose of enclosing balconies or patios: All exterior framing must be 6063-T6 aluminum finished in baked -on bronze enamel, to match the guard rail (Exhibits Bale. 1 and 2). The existing guard rail must remain on the outside. The screen panels shall be in widths compatible with the existing vertical lines of the building (Exhibits Balc. 3 and 4). The framing of screen panels on balconies shall be 92" high with one horizontal division level with the guard rail. On the ground floor, the framing shall be 96" high, and the horizontal division shall be 42" from the floor, equivalent to the level of the balcony guard rail. Where glass is provided, it shall be in two sections, the upper section running from the roof to the guard rail (or to the equivalent point on the ground floor); and the lower section running from that point to the floor. The glass shall match the screens in width, with an additional vertical division midway in each panel; the windows shall slide open horizontally. The glass will be placed six inches from the outside edge of the balcony or patio. On the ground floor patios, optional doors may be installed, as shown on Exhibit Balc. 2, where permitted by the City code. In the front of the building, the doors shall be placed on the patio return, where such returns exist. (On the back of the building, doors may be placed where desired.) All the balcony and patio enclosures must meet the City's building codes and architectural code.
