A RESOLUTION OF FINDINGS REGARDING THE APPLICATION OF ROGER
J. HALL FOR A VARIANCE UNDER SECTION 14-133(5) OF THE ST. LOUIS
PARK ORDINANCE CODE RELATING TO ZONING TO PERMIT THE
CREATION OF A LOT HAVING AN AREA OF 5,015 SQUARE FEET INSTEAD
OF THE REQUIRED 7,200 SQUARE FEET FOR PROPERTY LOCATED IN
THE R-2, SINGLE FAMILY RESIDENCE DISTRICT, AT 3870 YOSEMITE
AVENUE SOUTH.
BE IT RESOLVED BY The City Council of St. Louis Park, Minnesota:
1. On March 16, 1987, Roger J. Hall filed an application seeking a variance to
permit the creation of a lot having an area of 5,015 square feet instead of the
required 7,200 square feet for property located in the R-2, Single Family
Residence District, at 3870 Yosemite Avenue South, for the following legal
description as follows, to wit:
The south one-half of Lots 8, 9 and 10, Block 72, St. Louis Park,
Section 21, Township 117, Range 21
2. On March 26, 1987, the Board of Zoning Appeals recommended denial of the
variance on a vote of 6-0.
3. On April 20, 1987, the City Council held a public hearing, received testimony
from the public, discussd the application, and authorized preparation of a
resolution of denial on a vote of 5-0.
4. Based on the testimony, evidence presented, and files and records, the City
Council makes the following findings:
a. The requested variance does not meet the requirements of Section 14-219
and Section 14-220.1 of the Zoning Ordinance necessary to be met for the
City Council to grant a variance.
b. Granting of the requested variance is not necessary for the preservation
and enjoyment of a substantial property right. The applicant has use of
the property for a single family home which has existed for more than 50
years. The variance is sought to create a new substandard lot within the
existing parcel.
c. Granting of the requested variance would be contrary to the intent, purpose
and provisions of the Zoning Ordinance, since it would permit a new division
of property resulting in a lot containing only 5,015 square feet instead of
the required 7,200 square feet. Thus, the lot would meet only 70% of the
minimum requirements in the, R-2 District.
d. There is no demonstrable or undue hardship under the terms of the Zoning
Ordinance or Minnesota Sttltute since the applicant has use of the property
without a variance. Therefore, conditions necessary for granting the
requested variance do not exist.
