HomeMy WebLinkAbout87-51 - ADMIN Resolution - City Council - 1987/05/26RESOLUTION NO. 87-5] A RESOLUTION RESCINDING RESOLUTION NO. 86-133 ADOPTED ON AUGUST 18, 1986, RESCINDING RESOLUTION NO. 5402 ADOPTED ON NOVEMBER 3, 1975, WHICH AMENDED RESOLUTION NO. 5002 DATED FEBRUARY 19, 1974, WHICH AMENDED RESOLUTION NO. 4427 DATED JANUARY 10, 1972, AND GRANTING SPECIAL (CONDITIONAL USE) PERMIT UNDER SECTION 14-156(17) OF THE ST. LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO ALLOW A CLASS IV RESTAURANT FOR PROPERTY ZONED B-2, BUSINESS DISTRICT, AT 6320 WEST LAKE STREET FINDINGS WHEREAS, McDonald's Corporation has made application to the City Council for a special permit under Section 14-156(17) of the St. Louis Park Ordinance Code to allow a Class IV restaurant at 6320 West Lake Street within a B-2, Business District, having the following legal description: That part of Lots 5 and 6, Block 5, Maple Park Addition to St. Louis Park North, that part of Lots 8, 9 and 10, Block 5, St. Louis Park North and Lots 25 to 32 inclusive, Block 189, Rearrangement of St. Louis Park, described as commencing at a point in the north line of said Lot 4, Maple Park Addition to St. Louis Park North, 3.11 feet west of the northeast corner, thence in a southwesterly direction on a line on an assumed bearing of south 43° 12' 45" west for a distance of 104 feet to the actual point of beginning thence continuing southwesterly to the northwest corner of said Lot 32, Block 189, Rearrangement of St. Louis Park, thence southerly along the east line of Dakota - Avenue to its intersection with an extension of the northeasterly line of Wooddale Avenue; thence continuing southeasterly on the extension of the notheasterly line of Wooddale Avenue to the northwesterly line of Lake Street; thence northeasterly along the northwesterly line of Lake Street to the center line of vacated Colorado to the extension of a line drawn from the point of beginning to the southeast corner of said Lot 6, thence northwesterly along said line to the point of beginning and there terminating, including vacated alley. WHEREAS, the City Council has considered the advice and recommendation of the Planning Commission (Case Nos. 71 -44 -SP, 73 -66 -SP, 75 -71 -SP, 86 -61 -SP and 87 -16 -SP) and the effect of the proposed Class IV restaurant on the health, safety, and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area and the effect of the use on the Comprehensive Plan; and WHEREAS, a special permit was issued regarding the subject property pursuant to Resolution No. 86-133 of the St. Louis Park City Council dated August 18, 1986, which contained conditions applicable to said property; and WHEREAS, due to changed circumstances, amendments to those conditions are now necessary, requiring the amendment of that special permit; and WHEREAS, it is the intent of this resolution to continue and restate the conditions of the permit granted by Resolution No. 86-133 to add the amendments now required, and to consolidate all conditions applicable to the subject property in this resolution; CONCLUSION NOW THEREFORE BE IT RESOLVED that Resolution No. 86-133 (filed as Document No. 5152399) is hereby rescinded and replaced by this resolution which continues and amends a special permit to the subject property for the purposes of permitting a Class IV restaurant within the B-2, Business District at the location described above based on the following conditions: 1. The site and buildings shall be reconstructed, used and maintained in accordance with Exhibit A - SitePlan/Landscape Plan; Exhibit B - Left and Right Side Elevation Plan; Exhibit C - Front and Rear Elevation; Exhibit D - Roof Lighting Plan; Exhibit E - Floor Plan; Exhibit F - Rendering; Exhibit G - Sign Plan; and Exhibit 11 - Special Light Beam Specifications; except as modified by Exhibit I - Expanded Landscape Plan; Exhibit J - Expanded Site Plan; and Exhibit K - Drainage Plan. (Exhibits are on file in the City Development Department at the City of St. Louis Park.) 2. A screen shall be placed along the roof at the north side to screen roof top equipment. 3. Light beams on the roof as shown on Exhibit D shall have no more than .5 foot candles of light 28 inches from the source. 4. Concrete curbing shall be placed along the outside edges of all paved areas. 5. A raised concrete walk shall be extended from the east and west side of the building into the parking lot as shown on Exhibit A amended. 6. A suitable climbing vine planted 6 feet on center shall be provided along the fence on the north end of the property beginning at a point 56 feet east of the westerly lot line and extending to the easterly end of the proposed parking lot in accordance with the revisions shown on Exhibit J dated February 14, 1974. 7. Trees along the easterly edge of the employee parking lot shall be 2i inches in diameter and the variety shall be ash and maple. 8. Land shall be deeded to the City and easements shall be granted as shown as Exhibit J - Expanded Site Plan; prior to commencement of improvements shown on the exhibits. 9. De-icers such as sodium chloride and calcium chloride shall not be used on the parking lot. The washing of debris, sand; and other pollutants into the storm sewer shall be minimized. ip [p 10. All site improvements including paving, striping, and landscaping and drainage shall be completed by October 1, 1974. 11. That the exhibits referred to in Condition No. 1 are hereby modifed by Exhibit L - Revised Site Plan; Exhibit M - Revised Landscape Plan; Exhibit N - Footing and Foundation Plan; Exhibit 0 - Floor Plan; Exhibit P - Roof Framing Plan; Exhibit Q - Revised Elevation Plan; Exhibit R - Seating Plan; and Exhibit S - Seating and Partition Elevation; subject to the following: a. The pedestrian access points at the northeasterly and southwesterly sides of the building shall extend at least 16 feet into the parking lot area. b. Eating outside the building on the premises is prohibited in accordance with the provisions of the Zoning Ordinance. c. That all improvements including building, pedestrian facilities and landscaping be completed by June 1, 1976. d. Due to sight distance and traffic conditions, the access point on Dakota Avenue be signed and used for ingress only, and the most southwesterly access point on Lake Street be signed and used for exit only. 12. That the exhibits referred to in Condition No. 1 and Condition No. 11 are hereby further modified by: Exhibit T - Site Plan; Exhibit U - Elevations; and Exhibit V - Landscaping Plan; subject to the following: a. No building permits'shall be issued until the as -built landscaping plan is submitted to the City. Said plan, upon review and approval with respect to the ordinance requirements and conditions of this special permit, shall be marked Exhibit V - Landscaping Plan. b. The 8 -foot loss of turning movement created by the building expansion and parking lot rearrangement shall be reluced to as close to zero as possible. c. Four perpendicular parking spaces at the northeast corner of the site across the drive shall be clanged to two parallel spaces. d. A landscaped island shall be installed at the east end of the parallel spaces between the parallel spaces and the perpendicular spaces. e. All improvements shall be completed by May 31, 1987. 13. That the exhibits referred to in Condition Nos. 11 and 12 are hereby further modified by Exhibit W - Site Plan; Exhibit X - Landscape Plan; and Exhibit Y- Elevations, Drive -Through, subject to the following: a. The most northeasterly curb cut may be widened to 26 feet. b. Adjustments to drainage on the site may be required by Public Works at the time final construction drawings are prepared or submitted. c. A bike rack for storage of at least 10 bikes shall be located within 60 feet of the building on the edge of one of the landscaped -on -hard -surface areas not used or required for parking, driveway or access to the building. d. All street trees shall be 'at least 2 3/4" to 3" in diameter measured one foot off the ground at the time of planting. e. The boulevard on Dakota Avenue shall be re -landscaped upon removal of the driveway. Said landscaping to consist of sod and at least 3 street trees comparable to the trees to be planted on Lake Street. f. The only signs permitted are those on the plan and all directional signs, e.g. "enter," shall not be greater than 42 inches. g. That a pedestrian way be constructed at the northwest corner linking the site to the public walk on Dakota Avenue. h. All site improvements including building modifications, landscaping, driveways, striping, drainage and other elements shown on the exhibits shall be completed by October 15, 1987.
