HomeMy WebLinkAbout87-47 - ADMIN Resolution - City Council - 1987/04/20I RESOLUTION NO. 87-47 A RESOLUTION RESCINDING RESOLUTION NO. 6533 ADOPTED ON APRIL 7, 1980, AMENDING RESOLUTION NO. 6360 ADOPTED ON SEPTEMBER 17, 1979, AMENDING RESOLUTION NO. 6214 ADOPTED ON FEBRUARY 5, 1979, AND GRANTING SPECIAL (CONDITIONAL USE) PERMIT UNDER SECTION 14-124.101 OF THE ST. LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO ALLOW A RETAIL SHOPPING CENTER FOR PROPERTY LOCATED IN THE PUD, PLANNED UNIT DEVELOPMENT DISTRICT AT 3777 PARK CENTER BOULEVARD FINDINGS WHEREAS, Ryan Construction Company has made application to the City Council for a special permit under Section 14-124.101 of the St. Louis Park Ordinance Code to allow the construction of a retail shopping center at 3777 Park Center Boulevard within a PUD, Planned Unit Development District having the following legal description: Beginning at a point in the west line of Lot 4, Block 2, Park ' Center, distant 24 feet north from the southwest corner thereof; thence easterly parallel with south line thereof to a point 24 feet north and 423 feet west from the southeast corner of Lot 2 of said Block 2; thence north parallel with east line of said Lot 2 distant 401 feet; thence deflecting left 16 degrees, 35 minutes, 14 seconds, to northwesterly line of said Lot 2; thence westerly and southwesterly along northwesterly line of said Block 2 to the point of beginning, except Parcel No. 4 as delineated on Mn/DOT Right -of -Way Plat No 27-11. (Abstract) WHEREAS, the City Council has received a report on Case No. .87 -_24 -SP and has considered the advice and recommendation of the Planning Commission on Case Nos. 78 -120 -SP and 80 -24 -SP and the effect of the proposed retail shopping center on the health, safety, and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area and the effect of the use on the Comprehensive Plan; and WHEREAS, a special permit was issued regarding the subject property pursuant to Resolution No. 6533 of the St. Louis Park City Council dated April 7, 1980 which contained conditions applicable to said 4)roperty; and WHEREAS, due to changed circumstances, amendments to those conditions are now necessary, requiring the amendment of that special permit; and WHEREAS, it is the intent of this resolution to continue and restate the conditions of the permit granted by Resolution No. 6533 to add the amendments now required, and to consolidate all conditions applicable to the subject property in this resolution; CONCLUSION NOW THEREFORE BE IT RESOLVED that Resolution No. 6533 (Document not filed) is hereby rescinded and replaced by this resolution which continues and amends a special permit to the subject property for the purposes of permitting retail shopping center within the PUD, Planned Unit Development District at the location described above based on the following conditions: 1. The site shall be developed, used and maintained in accordance with Exhibit A - Site Plan; Exhibit B - Front Plaza Plan; Exhibit C - Landscape Plan; Exhibit D - Survey; Exhibit E - Utility Plan; Exhibit F - Sheets 1 and 2, General Floor Plan; and Exhibit G - Elevation Plans, except as modified by the elevation plans for the company dated September 13, 1979 and labeled Exhibit H - and the adjustment in the parking lot as shown on Exhibit I also dated September 13, 1979. However, landscaping can be adjusted with respect to type, size, quantity and location as shown on Exhibit C-1 and the sign for the liquor store can be Wines and Spirits. 2. All improvements, including structures, surfacing, landscaping, curbing, pedestrian facilities, berms, walls and other elements of the exhibits shall be completed by May 15, 1980, except planting of trees in the most westerly 33 foot wide landscape strip which can be delayed until October 15, 1981. 3. That Exhibit A - Site Plan; and Exhibit C - Landscape Plan in Condition No. 1 are hereby modified by Exhibit J - Byerly's Driveway Revision, only with respect to the location and geometries of the driveway and the parking layout immediately adjacent thereto, provided the islands are landscaped and directional traffic flow arrows are painted on the surface. All curbing shall be poured -in-place measuring at least 6 inches above and below grade. All improvements on Exhibit J including curbing, landscaping, striping and painted arrows shall be completed by May 30, 1987.
