HomeMy WebLinkAbout87-43 - ADMIN Resolution - City Council - 1987/04/208- t-89 8l inti, "v loa„,,,ti-, RESOLUTION NO. 87-43 A RESOLUTION RESCINDING RESOLUTION NO. 84-194 ADOPTED ON NOVEMBER 19, 1984, AND GRANTING SPECIAL (CONDITIONAL USE) PERMIT UNDER SECTION 14-171 OF THE ST. LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO ALLOW AN OPEN SALE AND RENTAL LOT FOR MOTOR VEHICLES AND A CONTRACTOR'S YARD FOR PROPERTY LOCATED IN THE I-1, INDUSTRIAL DISTRICT, AT 2231- 2239 EDGEWOOD AVENUE SOUTH FINDINGS WHEREAS, Leland and Mary Gottstein (Tamarack Materials, Inc.) have made application to the City Council for a special permit under Section 14-171 of the St. Louis Park Ordinance Code to allow an open sale and rental lot for motor vehicles at 2231-2239 Edgewood Avenue South within an I-1, Industrial District, having the following legal description: The South 231 feet of Tract B, Registered Land Survey No. 916, Files of Registrar of Titles, County of Hennepin (Torrens Certificate No. 646681) WHEREAS, the City Council has considered the advice and recommendation of the Planning Commission (Case Nos. 84 -95 -SP and 87 -13 -SP) and the effect of the proposed open sale and rental lot for motor vehicles on the health, safety, and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area and the effect of the use on the Comprehensive Plan; and WHEREAS, a special permit was issued regarding the subject property pursuant to Resolution No. 84-194 of the St. Louis Park City Council dated November 19, 1984 which contained conditions applicable to said property; and WHEREAS, due to changed circumstances, amendments to those conditions are now necessary, requiring the amendment of that special permit; and WHEREAS, it is the intent of this resolution to continue and restate the conditions of the permit granted by Resolution No. 84-194 to add the amendments now required, and to consolidate all conditions _nppli 'ahle to the subject property in this resolution; CONCLUSION NOW THEREFORE BE .IT RESOLVED that Resolution No. 84-194 (filed as Document No. 1617026) is hereby rescinded and replaced by this resolution which continues and amends a special permit to the subject property for the purposes of permitting an open sale and rental lot for motor vehicles within the I-1, Industrial District at the location described above based on the following conditions: 1. That the site be developed, used and maintained in accordance with Exhibit A - Site Plan and Exhibit B - Exterior Elevations. (Exhibits on file in the City Development Department at the City of St. Louis Park.) 2. Outdoor storage area for lease and for sale of vehicles is limited to the fenced in area on the east side of the building and not to exceed 22,200 square feet. 3. All lighting shall be directed away from residential property. 4. All drainage is subject to the approval of the City Engineer. 5. That the site is hereby permitted to be used as a contractor's yard in addition to the open sale and rental lot for motor vehicles.
