A RESOLUTION RELATING TO PROPOSED LEGISLATION
FOR A METROPOLITAN GROUNDWATER STUDY AND PLAN
Whereas, the City of St. Louis Park is interested in preserving, protecting
and improving the groundwater quantity and supply; and
Whereas, H.F. 373 and S.F. 353 relating to a groundwater study and plan for
Hennepin County were introduced in the 1987 Minnesota Legislature;
and
Whereas, these bills have been amended and now propose to incorporate groundwater
planning as part of the Surface Water Management Act and will allow,
but not require, all metropolitan counties to direct or delegate
the development of groundwater management plans; and
Whereas, the incorporation of a groundwater bill into the Surface Water Management
Act may confuse both the process and the existing legislation and
result in the enactment of this legislation on the mistaken premise
that groundwater planning can be included in the original surface
water management plans which have already been completed; and
Whereas, the City of St. Louis Park has reviewed this proposed legislation
and believes that, in light of the overlapping regulations that
currently exist concerning groundwater quantity and supply, the
enactment of additional legislation relating to groundwater should
not be pursued until cities, counties, water management organizations,
watershed districts state agencies and others who have expertise
in the area of groundwater have been involved in developing legislation
to protect these resources; and
Whereas, the City of St. Louis Park also believes that the proposed legislation
places a mandate for public expenditures upon local governments
without providing the funds needed to finance implementation activities,
Now, therefore, be it resolved by the City Council of the City of St. Louis
Park that consideration of H.F. 373 and S.F. 353 be delayed until such time
that a task force including membership from cities, counties, water management
organizations, watershed districts, state agencies and others having expertise
in groundwater matters be appointed and charged with developing a process
for addressing groundwater concerns in the metropolitan area.
