RESOLUTION NO. 87-23
A RESOLUTION RESCINDING RESOLUTION NO. 85-88.1 ADOPTED ON
JUNE 17, 1985, RESCINDING RESOLUTION NO. 7521 ADOPTED ON
DECEMBER 19, 1983 AND GRANTING PERMIT UNDER SECTION 14-
123.100(2), 14-107(2) and 14-195(2) OF THE ST. LOUIS PARK ORDINANCE
CODE RELATING TO ZONING TO ALLOW AN INDUSTRIAL
DEVELOPMENT UNIT WITH SIX MINI -WAREHOUSE BUILDINGS FOR
PROPERTY LOCATED IN THE I-1, INDUSTRIAL, AND F-2, FLOOD PLAIN
DISTRICTS, AT 3800 LOUISIANA AVENUE SOUTH
FINDINGS
WHEREAS, Irwin Mandel Development Corporation has made application to the City
Council for a special permit under Section 14-123.100(2), 14-107(2) and 14-195(2) of the
St. Louis Park Ordinance Code to allow an industrial development unit with six mini -
warehouse buildings within a I-1, Industrial District and an F-2, Flood Plain District District
at 3800 Louisiana Avenue having the following legal description:
Part of Rex Avenue and part of Block 160, 161 and 57A, Rearrangement of St.
Louis Park (Abstract and Torrens)
WHEREAS, the City Council has considered the advice and recommendation of the
Planning Commission (Case No. 83 -95 -SP) and the effect of the proposed six mini -warehouse
buildings on the health, safety, and welfare of the occupants of the surrounding lands,
existing and anticipated traffic conditions, the effect on values of properties in the
surrounding area and the effect of the use on the Comprehensive Plan; and
WHEREAS, a special permit was issued regarding the subject property pursuant to
Resolution No. 85-88.1 of the St. Louis Park City Council dated June 17, 1985 which
contained conditions applicable to said property; and
WHEREAS, due to changed circumstances, amendments to those conditions are now
necessary, requiring the amendment of that special permit; and
WHEREAS, it is the intent of this resolution to continue and restate the conditions
of the permit granted by Resolution No. 85-88.1 to add the amendments now required, and
to consolidate all conditions applicable to the subject property in this resolution;
CONCLUSION
NOW THEREFORE BE IT RESOLVED that Resolution No. 85-88.1 (filed as Document
No. 5025602) is hereby rescinded and replaced by this resolution which continues and
amends a special permit to the subject property for the purposes of permitting six mini -
warehouse buildings within the I-1, Industrial District and an F-2, Flood Plain District at
the location described above based on the following conditions:
1. The site shall be developed, used and maintained in accordance with Exhibit A,
Site Plan and Exhibit B, Plans, Elevations (Exhibits on file in the Planning
Department at City Hall).
2. The lowest floor elevation of any structure shall be at or above the flood
protection elevation of 895.0 feet N.G.V.D.II
3. The residential portion of the development shall be faced with materials complying
with the architectural control ordinance.
4. The exhibits contained in Condition No. 1 of this resolution are hereby modified
with respect to sanitary sewer and water utility, grading and drainage, and site
plan details related to building location, with proper provisions for City retention
of necessary easements for utilities and pedestrian purposes and as shown on
Exhibit C - Sanitary Sewer and Water Utility Plan Sheet Al -M, Exhibit D - Grading
and Drainge Plan Sheet Al -D, and Exhibit E - Site Plan Sheet Al.
5. Development of the site shall be completed by October 15, 1988.
