RESOLUTION AUTHORIZING EXECUTION OF TEMPORARY
EASEMENT TO THE STATE OF MINNESOTA TO ALLOW
CONSTRUCTION OF A NOISE BARRIER WALL ALONG I-394

WHEREAS, the State of Minnesota ha requested that the City of
St. Louis Park, Minnesota grant to the State of Minnesota an
easement over certain property owned by the City of St. Louis Park,
to facilitate construction of a noise barrier wall along I-394; and
WHEREAS, the State of Minnesota has offered to pay to the City
the sum of Twenty -One Thousand Three Hundred Eighteen and No/100
Dollars ($21,318.00) as consideration for the grant of said
temporary easement, which easement shall terminate no later than
December 31, 1989;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of St. Louis Park, Minnesota, that the City grant to the State of
Minnesota a temporary easement for highway purposes over the
property legally described in Exhibit A attached hereto.
BE IT FURTHER RESOLVED by the City Council of the City of St.
Louis Park, Minnesota, that the Mayor and City Manager are hereby
authorized and directed to execute a temporary easement agreement,
in form satisfactory to the City, for the purposes and pursuant to
the conditions described above.

RESOLUTION NO. 87-214
The temporary easement property described in the above -referenced
Resolution is legally described as follows:
Tract A. The north 10 feet of that tract of land dedicated as
"Park" on the plat of Inestdale Addition, filed in 26 of
Plots, Page 7, or September 27, 1954 an recorded in the
office of the Registrar of Titles in and for Hennepin
County, Minnesota, on November 5, 1954 as Document_ No.
440701;
Tract B. The north 10 feet of Lots 4 through 15 inclusive, Block
2, Murri-Mac Industrial Park Addition-R'Plat, according
to the plat thereof on file and of record in the office
of the County Recorder in and for Hennepin County,
Minnesota; the title thereto being registered as
evidenced by Certificate of Title No. 487683;
together with that part of Tracts C and D described below:
Tract C. That part of Lot 2, Block 2, Murri-Mac Industrial Park
Addition-RePlat, according to the plat thereof on file
and of record in the office of the County Recorder in and
for Hennepin County, Minnesota, lying southerly of a line
run parallel with and distant 360 feet northerly of the
south line of the Northeast Quarter of Section 6,
Township 117 North, Range 21 West, westerly of a line run
parallel with the east line of Lot 1, said Block 2, and
its southerly extension, distant 214 feet easterly
(measured along the north line of said Lot 2) from the
northwest corner thereof and northerly of a line run
parallel with and distant 82.5 feet southerly of the
easterly extension of the south line of said Lot 1; the
title thereto being registered as evidenced by
Certificate of Title No. 526361;

For and in consideration of the sum of Twenty -One Thousand Three
Hundred Eighteen and No/100 Dollars ($21,318.00), City of St. Louis
Park, a municipal corporation under the laws of the State of
Minnesota, Grantor, hereby grants to the State of Minnesota a
temporary easement to be used for highway purposes on all that part
of the following described property in Hennepin County, Minnesota:
The right to use all of Tracts A and B described below for highway
purposes, which right shall cease on December 31, 1989, or on such
earlier date upon which the Commissioner of Transportation
determines by formal order that it is no longer needed for highway
purposes:
Tract A. The north 10 feet of that tract of land dedicated as
"Park" on the plat of Westdale Addition, filed in 26 of
Plats, Page 7, on September 27, 1954 and recorded in the
office of the Registrar of Titles in and for Hennepin
County, Minnesota, on November 5, 1954 as Document No.
440701;
Tract B. The north 10 feet of Lots 4 through 15 inclusive, Block

Grantor is the owner of the above described premises and has the
lawful right and authority to convey and grant the temporary
easement herein granted.
And the said grantor, for itself, its successors and assigns, does
hereby release the State of Minnesota, its successors and assigns,
from any claims for damages to the above-described area covered by
this temporary easement, or any claims for damages to the remaining
property of grantor caused by the use of the temporary easement,
including grading and removal of materials from said easement for
highway purposes.
