HomeMy WebLinkAbout87-201 - ADMIN Resolution - City Council - 1987/12/07F RESOLUTION NO. 87-201 A RESOLUTION RESCINDING RESOLUTION NO. 5487 ADOPTED ON MARCH 1, 1976, AND GRANTING SPECIAL (CONDITIONAL USE) PERMIT UNDER SECTION 14-156(18) OF THE ST. LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO ALLOW AN AUTOMOBILE SERVICE CENTER FOR PROPETY LOCATED IN THE B-2, GENERAL BUSINESS DISTRICT, AT 4301 EXCELSIOR BOULEVARD FINDINGS WHEREAS, S & S Investments of Brooklyn Park, Inc. (John Williams, Jerome Essner and Stephen Barich) has made application to the City Council for a special permit under Section 14-156(18) of the St. Louis Park Ordinance Code to allow an automobile service center at 4301 Excelsior Boulevard within a B-2, General Business District, having the following legal description: Lots 1, 2, 3, and that part of Lot 4 described as follows: Commencing at the Northerly corner of Lot 4; thence in a Southwesterly direction along said Northwesterly line of Lot 4, 40 feet; thence in a Southeasterly direction parallel with the Southwesterly line of said Lot to the Easterly line of said Lot 4; thence North to the Northeasterly corner of said Lot 4; thence in a Northwesterly direction along the Northeasterly line of said Lot 4; to the point of beginning, "Bassford's Addition" to St. Louis Park (Torrens Certificate No. 668094) WHEREAS, the City Council has considered the advice and recommendation of the Planning Commission (Case No. 76 -6 -SP and 87 -61 -SP) and the effect of the proposed automobile service center on the health, safety, and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area and the effect of the use on the Comprehensive Plan; and WHEREAS, a special permit was issued regarding the subject property pursuant to Resolution No. 5487 of the St. Louis Park City Council dated March 1, 1976 which contained conditions applicable Co said property; and WHEREAS, due to changed circumstances, amendments to those conditions are now necessary, requiring the amendment of that special permit; and WHEREAS, it is the intent of this resolution to continue and restate the conditions of the permit granted by Resolution No. 5487 to add the amendments now required, and to consolidate all conditions applicable to the subject property in this resolution; CONCLUSION NOW THEREFORE BE IT RESOLVED that Resolution No. 5487 (Document not filed) is hereby rescinded and replaced by this resolution which continues and amends a special permit to the subject property •for the purposes of permitting automobile service center within the B-2, General Business District, at the location described above based on 'the following conditions: 1. The site shall be developed, used and maintained in accordance with Exhibit A - Site Plan/Landscape Plan; and Exhibit B - Elevation Plan. (Exhibits are on file in City Development at the City of St. Louis Park.) 2. The free-standing sign shall not exceed 66 square feet of sign surface per side. 3. All work and servicing shall take place totally within the building. 4. There shall be no outside storage or display of goods, refuse or trash. 5. No vehicle shall be parked or stored continuously on the site for more than 60 hours. 6. A concrete curb shall be provided around the periphery of all paved areas. 7. All exterior finishing, paving, curbing and landscaping shall be completed by October 1, 1976 8. That Condition No. 1 is hereby modified to permit two additional service bays and a storage area in accordance with Exhibit Al - Site Plan; Exhibit B1 - Elevation Plan, which includes cedar siding treatment on the east elevation; and Exhibit C1 - Floor which includes an enclosed indoor trash room; and all improvements shall be completed by May 31, 1988.
