RESOLUTION GRANTING EASEMENT FOR DRIVEWAY ACCESS
Oak Park Village
WHEREAS, a special (conditional use) permit was issued for a 164 -unit multiple
family development on Lot 1, Block 2, Oak Park Village, pursuant to Resolution No.
87-102 of the St. Louis Park City Council dated August 3, 1987; and
WHEREAS, the approved special permit provides for a private driveway south
to Walker Street; and
WHEREAS, a portion of said driveway encroaches upon City -owned park property,
requiring an access easement from the City; and
WHEREAS, said easement is described as follows:
An easement for access purposes over and across that part of PARK 2,
OAK PARK VILLAGE, according to the plat on file and of record in the
office of the County Recorder, Hennepin County, Minnesota, described
as follows:
Commencing at the most southwesterly corner of said PARK 2; thence
North 89°-25'-09" East, assumed bearing, along the south line of said
PARK 2, a distance of 13.15 feet to the actual point of beginning;
thence northwesterly along a non-tangential curve concave to the
southwest having a central angle of 17°-11'-53" and a radius of 116.00
feet for a distance of 34.82 feet, the chord of said curve bears
North 19°-24'-50" West; thence North 28°-00'-47" West a distance of
41.65 feet to the west line of said PARK 2; thence North 14°-26'-54"
West, along said west line a distance of 166.10 feet; thence North
01°-53'-30" West a distance of 15.24 feet; thence northeasterly along a
tangential curve concave to the east having a central angle of 15°-06'-36"
and a radius of 317.36 feet for a distance of 83.69 feet; thence North
13°-13'-06" East, tangent to the last described curve, a distance of
174.66 feet; thence northeasterly along a tangential curve concave to the
west having a central angle of 03°-01'-15" and a radius of 111.00 feet
for a distance of 5.85 feet to the west line of said PARK 2; thence
northeasterly along said west line, along a non-tangential curve concave
to the northwest having a central angle 25°-49'-27" and a radius of
150.00 feet for a distance of 67.61 feet, the chord of said curve bears
North 19°-53'-32" East; thence southerly along a non-tangential curve
concave to the west having a central_angle of 31°-24'-20" and a rads of
139.00 feet for a distance of 76.19 feet, the chord of said curve bears
South 02°-29'-04" East; thence South 13°-13'-06" West,tangent to the last
described curve, a distance of 174.66 feet; thence southwesterly along a
tangential curve concave to the southeast having a central angle of
15°-06'-36" and a radius of 289.36 feet for a distance of 76.31 feet;
thence South 01°-53'-30" East, tangent to the last described curve,
a distance of 63.36 feet; thence southeasterly along a tangential curve
concave to the northeast having a central angle of 26°-07'-18" and a radius
of 146.00 feet for a distance of 66.56 feet; thence South 28°-00'-47" East,
tangent to the last described curve, a distance of 83.31 feet; thence
southeasterly along a tangential curve concave to the southwest having a
central angle of 19°-12'-13" and a radius of 144.00 feet for a distance of
48.27 feet to the south line of said PARK 2; thence South 89°-25'-09" West,
not tangent to the last described curve and along said south line, a distance
of 28.36 feet to the point of beginning.
NOW THEREFORE BE IT RESOLVED THAT the City of St. Louis Park hereby
grants the above-described non exclusive easement for the purpose of constructing
and utilizing a private driveway on a portion of City -owned park property, in
conjunction with the special (conditional use) permit for a 164 -unit multiple family
development on Lot 1, Block 2, Oak Park Village.
