HomeMy WebLinkAbout87-180 - ADMIN Resolution - City Council - 1987/10/19RESOLUTION NO. 87-180 A RESOLUTION RESCINDING RESOLUTION NO. 86-64 ADOPTED ON MAY 19, 1986, RESCINDING RESOLUTION NO. 5646 ADOPTED ON NOVEMBER 29, 1976 AND RESOLUTION NO. 5351 ADOPTED ON SEPTEMBER 2, 1975 (AND RESCINDING ANY PREVIOUS RESOLUTIONS APPROVING OR AMENDING SPECIAL PERMITS FOR THE SUBJECT PROPERTY), AND GRANTING SPECIAL (CONDITIONAL USE) PERMIT UNDER SECTION 14-141(7) OF THE ST. LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO PERMIT AN OFFICE BUILDING FOR PROPERTY ZONED R-4, MULTIPLE FAMILY RESIDENCE DISTRICT, AT 6217 EXCELSIOR BOULEVARD FINDINGS WHEREAS, Dale and Linda Murray have made application to the City Council for a special permit under Section 14-141(7) of the St. Louis Park Ordinance Code to allow an office building at 6217 Excelsior Boulevard within a R-4, Multiple Family Residence District having the following legal description: East 1/2 of north 1/2 of Lot 7, and east 1/2 of Lot 8, Block 10, "Brookside," except road, according to the plat thereof in and for Hennepin County, MN (Abstract) WHEREAS, the City Council has considered the advice and recommendation of the Planning Commission (Case Nos. 75 -53 -SP, 76 -80 -SP, 86 -23 -SP and 87 -66 -SP) and the effect of the proposed office building on the health, safety, and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area and the effect of the use on the Comprehensive Plan; and WHEREAS, a special permit was issued regarding the subject property pursuant to Resolution No. 86-64 of the St. Louis Park City Council dated May 19, 1986, which contained conditions applicable to said property; and WHEREAS, the special permit granted by Resolution No. 86-64 was not used and has expired; and WHEREAS, it is the intent of this resolution to continue and restate the conditions of the permit granted-by._ftesoluli.on No. 86-64, to add the _amendments -rnow required nd to consolidate all conditions applicable to the subject property in this resolution; CONCLUSION NOW THEREFORE BE IT RESOLVED that Resolution No. 86-64 (filed as Document No. 5115855) is hereby rescinded and replaced by this resolution which continues and amends the special permits to the subject property for the purposes of an office building within the R-4, Multiple Family Residence District at the location described above based on the following conditions: 1. The site shall be developed, used and maintained in accordance with Exhibit A - Site Plan; Exhibit B - Main Floor Plan; and Exhibit C - Lower Level Floor Plan. (Exhibits are on file in the City Development Department at the City of St. Louis Park.) 2. Concrete curb stops shall be installed and anchored along the perimeter of the parking lot. 3. The structure shall not contain more than 1,445 net square feet of floor area. 4. The parking lot shall be striped for 13 parking stalls. 5. A 6 -foot high fence shall be constructed of solid, durable material and shall be maintained structurally and for uniformity of appearance and that a gate or some other type of access be provided to allow maintenance of the applicant's property outside the fence. 6. The sign in the front yard setback shall be removed and any replacement signing shall comply with the Sign Ordinance. 7. Any exterior lighting on the site shall be located in such a manner that light rays from the fixture are directed perpendiculary to the ground and are not directly visible from adjacent properties. 8. There shall be no outside storage of trash or trash containers on the site. 9. The climbing tower in the rear yard shall be removed. 10. The large dead Locust tree at the southwest corner of the property shall be removed at the owner's expense. 11. All improvements shall be completed by May 15, 1988.
