RESOLUTION REQUESTING VARIANCE FROM
MINNESOTA RULES 8820.1400, SUBPART 4
TO ALLOW THE CITY OF ST. LOUIS PARK TO OBTAIN AN AMOUNT
GREATER THAN THE ESTABLISHED MINIMUM ALLOTMENT FOR
MUNICIPAL STATE AID STREET MAINTENANCE
WHEREAS, the City of St. Louis Park, Minnesota, desires to receive an
amount greater than the established minimum allotment for Municipal State Aid
street maintenance for 1987 from its State Aid payment; and
WHEREAS, the City of St. Louis Park, Minnesota, had intended to submit a
request for said allotment, but due to oversight failed to provide said request
prior to the established December 15, 1986 deadline; and
WHEREAS, the City of St. Louis Park, Minnesota, had established its 1987
Street Maintenance budget based upon receipt of a $50,000 Municipal State Aid
Street Maintenance allotment.
NOW, THEREFORE, BE IT RESOLVED by the City of St. Louis Park, Minnesota,
that it hereby requests the Commissioner of Transportation grant a variance
from Minnesota Rules 8820.1400, Subpart 4, allowing the City to receive $50,000
in Municipal State Aid Street Maintenance funds rather than the previously
approved payment amount of $33,270 which was based upon the rate of $1,500 per
mile of improved Municipal State Aid Streets.
Adopted by the City Council February 17, 1987.

Petition of the City of St. Louis Park for a Variance from State Aid Administrative
Requirements for the Determination of Maintenance Monies
Notice is hereby given that the City Council of the City of St Louis Park has made a written request to the Commissioner of
Transportation pursuant to Minnesota Rules § 8820 3300 for a variance from requirements for establishing their 1987 Maintenance
Allocation
The request is for a variance from Minnesota Rules for State Aid Operations § 8820 1400 adopted pursuant to Minnesota Statutes
Chapter 161 and 162, so as to permit the City of St Louis Park to Increase their 1987 Maintenance Allotment by S16,730 00
Any person may file a written objection to the variance request with the Commissioner of Transportation, Transportation Building,
St. Paul, Minnesota 55155
If a written objection is received within 20 days from the date of this notice in the State Register, the variance can be granted
only after a contested case hearing has been held on the request

is a party, or acts as an agent for a party under Minnesota Statutes, section 161 36, subdivisions 2 and 3, 360 016, subdivisions 2
and 3, or 360 039, subdivisions 2 and 3,
B for which competitive bids are required or taken; and
C. which is subject to the approval of the commissioner
Minnesota Rule 1230 4200, Subpart 1, states -
Order of suspension The commissioner of transportation shall suspend a person or business by order upon receiving notice
or learning of a conviction for conduct described in part 1230 3200 or upon receiving evidence of an affiliation described in part
1230 3600, subpart 2.
1. You are suspended because you were convicted of violations of Minn Stat sections 325D 53, subd 1(2) in Nobles County in
District Court in the Fifth Judicial District in Minnesota on Apnl 12, 1985
Debarment proceedings against you will begin within 10 days

Upon review of the City of St Louis Park's request for a variance
from the Minnesota Rule 8820.1400 so as to permit an increase in the
City of St. Louis Park's 1987 Maintenance Allotment, I hereby grant
the variance.
The variance is conditional upon receipt of a resolution by the City
Council of the City of St. Louis Park that indemnifies, saves and
holds harmless the State of Minnesota and all its agents and
employees of and from any and all claims, demands, actions or causes
of actions of any nature or character arising out of or by reason
of, in any manner, the granting of the increase in the City of St.
Louis Park's 1987 Maintenance Allotment in any other manner than as
in accordance with Minnesota Rule 8820.1400 and further agrees to
defend at their sole cost and expense any action or proceeding
commenced for the purpose of asserting any claim of whatsoever
character arising as a result of the granting of this variance.
The City of St. Louis Park must further agree to file a detailed
maintenance expenditure report for 1987 with the Commissioner of
Transportation.

RESOLUTION HOLDING THE STATE OF MINNESOTA HARMLESS FOR
ISSUANCE OF A VARIANCE RELATIVE TO THE DISTRIBUTION OF
MUNICIPAL STATE AID MAINTENANCE FUNDS
WHEREAS, the City of St. Louis Park, Minnesota, has requested a variance
from Minnesota Rule 8820.1400 so as to permit an increase in the City of St.
Louis Park's 1987 Maintenance Allotment from its Municipal State Aid account;
and
WHEREAS, the Commissioner of Transportation has granted said variance
pursuant to receipt of a City Council adopted resolution indemnifying the State
for its actions taken in granting said variance.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL of the City of St.
Louis Park, Minnesota that it indemnifies, saves and holds harmless the State
of Minnesota and all its agents and employees of and from any and all claims,
demands, actions or causes of actions of any nature or character arising out of
or by reason of, in any manner, the granting of the increase in the City of St.
Louis Park's 1987 Maintenance Allotment in any other manner than as in
accordance of Minnesota Rule 8820.1400 and further agrees to defend at its sole
