HomeMy WebLinkAbout87-168 - ADMIN Resolution - City Council - 1987/10/05(( _ )4,e, , ?.? 3 7 ) RESOLUTION NO. 87_ A RESOLUTION RESCINDING RESOLUTION NO. 86-143 ADOPTED ON SEPTEMBER 2, 1986, RESCINDING RESOLUTION NO. 85-224 ADOPTED ON DECEMBER 16, 1985, RESCINDING RESOLUTION NO. 85-66 ADOPTED ON MAY 20, 1985, AND GRANTING SPECIAL (CONDITIONAL USE) PERMIT UNDER SECTION 14-124.101 AND 14-210.2 OF THE ST. LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO ALLOW THE CONSTRUCTION OF A 167 -UNIT RESIDENTIAL APARTMENT DEVELOPMENT ON PROPERTY ZONED PUD, PLANNED UNIT DEVELOPMENT, AT 7400 HIGHWAY 7 FINDINGS WHEREAS, St. Louis Park Housing Associates (Dominium Group Incorporated) has made application to the City Council for a special permit under Section 14-124.101 and 14-210.2 of the St. Louis Park Ordinance Code to allow the construction of a 167 -unit residential apartment development at 7400 Highway 7 within a PUD, Planned Unit Development District, having the following legal description: Lots 1, 2 & 3 Auditor's Subdivision 327 including vacated street and alley Lots 1, 2, 3, and 40 to 48 inclusive, Block 316, rearrangement of St. Louis Park including vacated alley and part of Lot 6, Block 323, rearrangement of St. Louis Park. Described as commencing at the southeast corner of Lot 10, then_ southerly along westerly line of Lot 6 to northerly line of State Highway No. 7 then northeasterly along northerly line of said Highway to a point in a line parallel with and 40 feet westerly from easterly line of Lot 6 then northerly along said parallel line to the intersection with south line of Lot 10 extended east then west to beginning. (Abstract) WHEREAS, the City Council has considered the advice and recommendation of the Planning Commission (Case Nos. 85 -20 -SP, 85 -83 -SP, and 87 -69 -SP) and the effect of the proposed 167 -unit residential apartment development on the health, safety, and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area and the effect of the use on the Comprehensive Plan; and WHEREAS, a special permit was issued regarding the subject property pursuant to Resolution No. 86-143 of the St. Louis Park City Council dated September 2, 1986, which contained conditions applicable to said property; and WHEREAS, due to changed circumstances, Amendments to those -conditions -are -now necessary, requiring the amendment of that special permit; and WHEREAS, it is the intent of this resolution to continue and restate the conditions of the permit granted by Resolution No. 86-143 to add the amendments now required, and to consolidate all conditions applicable to the subject property in this resolution; CONCLUSION NOW THEREFORE BE IT RESOLVED that Resolution No. 86-143 (Not filed. Resolution No. 85-224 filed as Document No. 5067858) is hereby rescinded and replaced by this resolution which continues and amends a special permit to the subject property for the purposes of permitting a 167 -unit residential apartment development within the PUD, Planned Unit Development District, at the location described above based on the following conditions: 1. That the site be developed, used and maintained in accordance with Exhibit A - Site Plan, Exhibit B - Landscape Plan, Exhibit C - a basement parking plan for general purposes, Exhibits E and F - Floor Plans, Exhibits G, H, and I - Elevation Plans, and by the conditions which follow. (Exhibits are on file in the City Development Department at the City of St. Louis Park.) 2. That all light be directed perpendicular to the ground (unless globe lighting) and that no standard be higher than 20 feet as measured from the ground. 3. There be no outdoor storage of trash or trash containers. 4. There be.at least 400 square feet of outside, usable open space per unit. 5. That the applicant or its successors and assigns be responsible for a pedestrian way; and that applicant or successors and assigns be responsible for planting of boulevard sod, boulevard trees along the south side of Walker, east side of Pennsylvania Avenue and the south frontage road system to its connection with Walker. 6. That if the City determines a need for additional parking, the applicant or its succesors and assigns shall be responsible for providing 41 additional parking spaces. 7. That all utilities be placed underground. 8. That construction of the building shall commence on or before September 22, 1986. 9. That all improvements including buildings, parking, street improvements and striping be completed by December 1, 1987, except for landscaping which shall be completed by June 1, 1988. 10. That modifications to Exhibit A and Exhibit B in Condition No. 1 are hereby permitted in accordance with Exhibit J - Proof of Parking Plan; and Exhibit K - Planting Plan Addendum No. 2, with respect only to the parking lot at the notheast corner of the property and access to the frontage road and with respect to providing an additional 14 parking spaces. The applicant and the applicant's successors and assigns have the authorization to install the 14 additional parking spaces as shown on Exhibit J. The applicant and the applicant's successors and assigns may be required by the City to construct said 14 parking spaces in the event the City, at its sole discretion, determines that parking is not adequate on the site. Said modifications, except for the 14 additional parking spaces, are to be completed by October 15, 1987. If the 14 additional parking spaces are required by the City, the completion date for said parking will be specified in such City action.
