RESOLUTION NO. 87-16
RESOLUTION DECLARING CITY PUBLIC NEED
FOR COUNTY OWNED PROPERTY
3.8 ACRE PARCEL AT FLAG AVENUE AND COUNTY ROAD 18
WHEREAS, the City Council of St. Louis Park has received notice from Hennepin
County regarding their interest in selling residual property; and
WHEREAS, the City Council has determined there is a City public need for a
portion of this property; and
WHEREAS, designation of the area of public need cannot be determined except
through applying extraordinary controls available to the City related to at least
subdivision, zoning and special permit provisions; therefore
BE IT RESOLVED that the City Council hereby states it objects to Hennepin
County's disposition of the property described below:
That part of the Northwest Quarter of the Southwest Quarter, Section 18,
Township 117, Range 21, Hennepin County, Minnesota, described as follows:
Commencing at the northwest corner of the Southwest Quarter of
said Section 18; thence on an assumed bearing of South 89 degrees
59 minutes 26 seconds East along the north line of said Southwest
Quarter a distance of 585.18 feet to the point of beginning of the
land to be described; thence South 37 degrees 26 minutes 02 seconds
East, 85.32 feet; thence South 30 degrees 58 minutes 46 seconds
East, 99.05 feet; thence southeasterly 189.44 feet along a tangential
curve, concave to the northeast, having a radius of 1010.41 feet
and a central angle of 10 degrees 44 minutes 33 seconds; thence
South 41 degrees 43 minutes 19 seconds East, tangent to said curve,
162.51 feet; thence South 36 degrees 46 minutes 18 seconds East,
289.02 feet to the southerly extension of the west line of Flag
Avenue, as dedicated in MINNEHAHA GABLES 2ND ADDITION;
thence northerly along the southerly extension of said west line
to the north line of said Southwest Quarter, thence North 89
degrees 59 minutes 26 seconds West along said north line to the
point of beginning.
Subject to an easement, 20.00 feet in width, for drainage purposes across
that part of the above described tract of land lying 10.00 feet on each side
of the following described center line:
Beginning at a point on the southwesterly line of the above described
tract of land distant 275.37 feet southeasterly, as measured along
said southwesterly line, from the northwesterly corner of said tract
of land; thence North 72 degrees 30 minutes East, 40.00 feet and
said center line there terminating.
The side lines of said easement extend from the southwesterly line of the
above described tract of land to a line which is perpendicular to the above
described center line at its point of termination.
BE IT FURTHER RESOLVED, that Hennepin County be informed of the following:
1. That the City has a public need consisting of park and open space for a
portion of the property.
2. The area of park and open space will be determined by the City developing
a plan and applying its subdivision, zoning and special permit provisions to
the mutual benefit of the County, City, the residential neighborhood and
any developer of said property.
3. That any buyer of the subject property be made aware of the zoning and
subdivision requirements of the City of St. Louis Park including public open
space requirements associated with PUD and cluster housing as may be
appropriate and as applicable to the property.
4. That the potential developer(s) be aware that the neighborhood has requested,
and the City, concurs, that development of the subject property be comparable
in size and value with abutting single family homes.
5. Upon completion of the plan as described in Item 2 above, the City will
submit the proposal to the County after which time the process of sale of
a portion of the property can be discussed with the County.
