HomeMy WebLinkAbout87-153 - ADMIN Resolution - City Council - 1987/09/21RESOLUTION NO. 87-153 A RESOLUTION STATING POLICY AS TO ACTION ON PETITION FOR ALLEY IMPROVEMENT AND RESCINDING RESOLUTION NO. 4177 WHEREAS, the City has had experience over a long period of time with petitions for various types of local improvements, and WHEREAS, this experience has indicated that a general policy for the petitioning of alley improvements and the requirements for each should be as hereinafter set forth; and WHEREAS, formalizing policy for the guidance of the Council, officers, employees and taxpayers is desirable to produce a more orderly phasing of administration and construction of alley improvement projects; NOW, THEREFORE, BE IT RESOLVED by the City Council of St. Louis Park that for purposes of investigation and preparation of engineering and assessing data, improvement proceedings and other administrative matters, in the absence of other instructions or action by the City Council not less than fifty-one percent (511) of the assessable frontage of the real property abutting on the alley named in the petition shall be required in a petition to the City Council. The City Council may waive the fifty-one percent (511) requirement; however, in accordance with M.S. 429.031, not less than thirty-five percent (351) of the assessable frontage of the real property abutting on the alley named in the petition shall be required. Be it further resolved that all provisions of Resolution No. 4177 adopted March 8, 1971 are incorporated herein and reaffirmed, and that Resolution No. 4177 is hereby rescinded.
