A RESOLUTION RESCINDING RESOLUTION NO. 7376 ADOPTED ON MAY
2, 1983, AND GRANTING SPECIAL (CONDITIONAL USE) PERMIT UNDER
SECTION 14-124.101 OF THE ST. LOUIS PARK ORDINANCE CODE
RELATING TO ZONING TO ALLOW THE CONVERSION OF A SINGLE
FAMILY RESIDENCE TO OFFICE USE AND TO PERMIT THE
CONSTRUCTION OF A STORAGE BUILDING FOR PROPERTY LOCATED
IN THE PUD, PLANNED UNIT DEVELOPMENT DISTRICT, AT 4045 VERNON
AVENUE
FINDINGS
WHEREAS, Thomas W. Ryter and John G. Schutz has made application to the City
Council for a special permit under Section 14-124.101 of the St. Louis Park Ordinance
Code to allow the conversion of a single family residence to office use at 4045 Vernon
Avenue South within a PUD, Planned Unit Development District, having the following legal
description:
Lots 41 and North 3 feet of Lot 40, except highway, Block 3, Browndale
Addition (Abstract)
WHEREAS, the City Council has considered the advice and recommendation of the
Planning Commission (Case Nos. 83 -20 -SP and 87 -57 -SP) and the effect of the proposed
conversion of a single family residence to office use on the health, safety, and welfare of
the occupants of the surrounding lands, existing and anticipated traffic conditions, the
• effect on values of properties in the surrounding area and the effect of the use on the
Comprehensive Plan; and
WHEREAS, a special permit was issued regarding the subject property pursuant to
Resolution No. 7376 of the St. Louis Park City Council dated May 2, 1983 which contained
conditions applicable to said property; and
WHEREAS, due to changed circumstances, amendments to those conditions are now
necessary, requiring the amendment of that special permit; and
WHEREAS, it is the intent of this resolution to continue and restate the conditions
of the permit granted by Resolution No. 7376 to add the amendments now required, and
to consolidate all conditions applicable to the subject property in this resolution;
CONCLUSION
NOW THEREFORE BE IT RESOLVED that Resolution No. 7376 (filed as Document No.
4794187) is hereby rescinded and replaced by this resolution which continues and amends
a special permit to the subject property for the purposes of permitting the conversion of
a single family residence to office use and to permit the construction of an accessory
storage building within the PUD, Planned Unit Development District, at the location
described above based on the following conditions:
1. The site shall be developed, used and maintained in accordance with Exhibit A - Plot
and Elevation Plan; Exhibit B - First Floor Plan; Exhibit C - Second Floor Plan; and
Exhibit D - Basement Floor Plan. (Exhibits are on file in City Development at the
City of St. Louis Park)
2. There be no more than one tenant occupying the building.
3. The maximum net floor area used for office space shall not exceed 890 square feet.
4. Occupany of the basement shall be prohibited.
5. All improvements shall be completed by October 31, 1983.
6. That Condition No. 1 is hereby modified to permit an accessory storage building
measuring 8 feet wide by 12 feet long by 8 feet high in the rear yard of the property
in accordance with Exhibit Al - Plot and Elevation Plan; Exhibit F - Perspective
Drawing; and Exhibit G - Exterior Materials Plan; and all improvements shall be
completed by October 31, 1987.

When a vehicle is brought on-site, all fluids remaining in the vehicle
will be drained from the vehicle. -Gasoline from the gas tank will be
drained into 5 -gallon gas cans and stored in the main building for use in
on-site vehicles. Diesel fuel will be drained into 5 -gallon cans marked
kerosene and will be stored on-site for cleaning parts. Radiator fluid
will be drained from the radiator, strained to remove rust particles and
stored in a 55 -gallon drum for resale and reuse. The drum will be labeled
"ethylene glycol/water mixture" and will be stored in the pole shed behind
the main building. Transmission fluid, brake fluid, power steering fluid,
and engine oil will be drained to a 55 -gallon drum for recycling. The drum
will be labeled "waste oil" and will be stored in the pole shed behind the
main building. A waste recycler (Warden or Solve -Oil) will be contacted to
pick up the waste oils when 55 gallons of waste oil has accumulated.
Washer solvent will be drained from the vehicle into 1 -gallon plastic jugs
and discharged to the sanitary sewer. A container of Floor-Dri will be
stored in the vicinity of the work area and storage area to be used to
absorb any spills of waste oil, radiator fluid or washer fluid.
Batteries will be removed from the vehicle when it is brought to the
site and will be stored in the pole shed in a containment area. The
containment area will provide for storage of acid from leaking batteries.
The containment area will consist of a 2 -inch by 4 -inch wooden frame to act
as a curb which will be lined with a thick plastic sheet attached to the
2 -inch by 4 -inch frame. A bag of wood chips will be stored in the vicinity
of the containment area to be used to absorb acid spills from leaky
batteries. The batteries will be shipped at least every 6 months to a
recycler.
