A RESOLUTION GRANTING SPECIAL (CONDITIONAL USE) PERMIT UNDER
SECTION 14-124.101 OF THE ST. LOUIS PARK ORDINANCE CODE RELATING
TO ZONING TO PERMIT THE EXPANSION OF A FUNERAL HOME FOR PROPERTY
ZONED PUD, PLANNED UNIT DEVELOPMENT DISTRICT, LOCATED AT 3960
WOODDALE AVENUE
BE IT RESOLVED BY the City Council of the City of St. Louis Park:
Findings
1. Flower Realty Inc. and J -K Enterprise (Delmore Realty Co.) has made application
to the City Council for a special permit under Section 14-124.101 of the St. Louis Park
Ordinance Code for the purpose of expanding a funeral home within a PUD, Planned Unit
Development District, located at 3960 Wooddale Avenue for the legal description as follows,
to -wit:
Lots 1 and 2, Billmans Addition (Abstract)
2. The City Council has considered the advice and recommendation of the Planning
Commission (Case No. 87 -59 -SP) and the effect of the proposed funeral home expansion
on the health, safety and welfare of the occupants of the surrounding lands, existing and
anticipated traffic conditions, the effect on values of properties in the surrounding area,
the effect of the use on the Comprehensive Plan, and compliance with the intent of the
Zoning Ordinance.
3. The Council has determined that the proposed funeral home expansion will not
be detrimental to the health, safety, or general welfare of the community nor will it
cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding
property values, and the -proposed- funeral home expansion is in harmony with the general
purpose and intent of the Zoning Ordinance and the Comprehensive Plan.
Conclusion
The special permit to permit the expansion of a funeral home at the location described
is granted based on the findings set forth above and subject to the following conditions:
1. The site shall be developed, used and maintained in accordance with Exhibit A - Site
Layout and Floor_P1an, except that the identification sign by the driveway shall be
set back a minimum of seven -feet -from the right-of-way line of Wooddale Avenue
and the letter height shall not exceed six inches; Exhibit B - Landscape Plan; Exhibit
B-1 - Parking Screen Wall; Exhibit C - Utility Plan; and Exhibit D - Exterior Elevations,
consisting of brick on all walls matching the existing building. (Exhibits are on file
in City Development at the City of St. Louis Park)
2. All outdoor lighting, other than globe lighting, shall be no higher than 25 feet above
the ground and shall direct all light rays perpendicular to the ground.
3. All curbing shall be poured -in-place concrete measuring six inches above and below
grade.
4. All improvements shall be completed by October 15, 1988.
