HomeMy WebLinkAbout86-67 - ADMIN Resolution - City Council - 1986/06/02RESOLUTION NO. 86-67 A RESOLUTION RESCINDING RESOLUTION NO. 85-125 ADOPTED ON SEPTEMBER 3, 1985, AND GRANTING SPECIAL (CONDITIONAL USE) PERMIT UNDER SECTION 14-124.101 OF THE ST. LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO ALLOW THE CONSTRUCTION OF A DISCOUNT DEPARTMENT STORE CONTAINING 85,000 GROSS SQUARE FEET FOR PROPERTY LOCATED IN THE PUD, PLANNED UNIT DEVELOPMENT DISTIRCT, AT 3601 SOUTH HIGHWAY 100 FINDINGS WHEREAS, Target Stores/Dayton Hudson Corporation has made application to the City Council for a special permit under Section 14-124.101 of the St. Louis Park Ordinance Code to allow the construction of a discount department store containing 85,000 gross square feet at 3601 South Highway 100 within a PUD, Planned Unit Development District having the following legal description: That part of Lot 1, Block 1, Park Center Addition, except that part described i as parcels 2 and 3 Minnesota Department of Transportation Right -of -Way Plat 27-11 (Abstract) WHEREAS, the City Council has considered the advice and recommendation of the Planning Commission (Case No. 85 -29 -SP and 86 -5 -SP) and the effect of the proposed discount department store on the health, safety, and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area and the effect of the use on the Comprehensive Plan; and WHEREAS, a special permit was issued regarding the subject property pursuant to Resolution No. 85-125 of the St. Louis Park City Council dated September 3, 1985 which contained conditions applicable to said property; and WHEREAS, due to changed circumstances, amendments to those conditions are now necessary, requiring the amendment of that special permit; and WHEREAS, it is the intent of this resolution to continue and restate the conditions of the permit granted by Resolution No. 85-125 to add the amendments now required, and to consolidate all conditions applicable to the subject property in this resolution; CONCLUSION NOW THEREFORE BE IT RESOLVED that Resolution No. 85-125 (filed as Document No. 5033377) is hereby rescinded and replaced by this resolution which continues and amends a special permit to the subject property for the purposes of permitting discount department store containing 85,000 gross square feet within the PUD, Planned Unit Development District at the location described above based on the following conditions: 1. That the site be developed, used and maintained as shown on Exhibit A - Site Layout Plan approved November 16, 1981; Exhibit B - Grading and Drainage Plan approved November 16, 1981; Exhibit C - Landscape Plan approved November 16, 1981; and Exhibit D - Parking Circulation Plan approved November 16, 1981; except as modified by the following conditions: (Exhibits originally filed with Case No. 81 -94 -SP in the City Development Department at the City of St. Louis Park.) 2. There be no outdoor display, sale or storage except in the Garden Center which shall be used only for sale of nursery stock and garden supplies. 3. Said Garden Center shall be enclosed with decorative wall or fence or a combination thereof which shall be 25% opaque and shall be at least 4i feet high. 4. The area at the southeast corner of the Garden Center, located between said corner and the landscape setback, shall be landscaped and designed to prohibit automobiles, trucks and other vehicles from ingress and/or egress between the truck loading area and the parking area to the south. 5. There shall be no trucks or trailers parked or stored on the site except at the loading docks which shall be used exclusively for loading and unloading. 6. There shall be no vehicle access on West 36th Street. All access is limited to the driveways shown on the exhibits. 7. The applicant understands that all their parking, including trucks, is to be prohibited on West 36th Street and Park Center Boulevard. 8. A five foot wide sidewalk shall be constructed along the lot line adjacent to Park Center Boulevard with ramps at driveways and grades no more than 3% within the driveway sections. 9. The Discount Store including Restaurant and TBA, shall provide six off-street parking spaces per 1,000 square feet of gross floor area. 10. All exterior walls shall be brick or other materials or combination which meet the architectural provision of the City and the Redevelopment Area. 11. All rooftop equipment shall be screened with decorative materials. 12. There shall be no outdoor storage of trash, tires, grocery carts or customer's carts or any other materials, goods or equipment except as allowed in the Garden Center. 13. All parking islands shall be landscaped with a minimum of two trees for each island and sod or other ground cover. 14. All deciduous trees to be planted as required by the exhibit and condition shall be a minimum of three inches in diameter measured one foot above the ground at the time of planting. All coniferous trees so required shall be at least six to eight feet high at the time of planting. 15. A walkway with at least a five foot wide clearance from vehicle overhang shall be constructed between the main entrance to the building and the south property line. 16. All outside lighting shall be designed so all rays are directed perpendicular to the ground. Such lighting shall not be more than thirty feet high. r 17. One free standing sign, no higher than twenty-five feet, shall be permitted containing no more than 300 sq. ft. of total sign area including all sides. The maximum allowed sign area including the free standing sign and all signs on the building shall be 850 sq. ft. No sign shall be located within twenty feet of any right-of-way line. 18. The landscaped berms along the perimeter of the site shall have an underground sprinkling system. 19. There shall be no changes in the parking angles, access, landscaping, signage, walkways, building location or uses unless an amendment to the special permit is approved. 20. The perimeter of the parking lot and the islands in the lot shall have a poured in place concrete curb extending at least six inches above and below the asphalt surfacing. 21. All cost associated with design and construction of a traffic signal located at the access point, if one is necessary, shall be paid by the owner(s) of the subject property. 22. This permit and exhibits and conditions thereto are grants and obligations to the land owners, applicants and their successors and assigns. 23. Snow shall be cleared from the site to retain the required number of parking spaces as specified in Condition No. 9. 24. Approval by the City does not constitute approval or concurrence in use of excavation material from excavation of the interchange at West 36th Street and Highway 100. 25. Utilities and driveway aprons be constructed according to City specifications and the requirements of the City Engineer. 26. All work including landscaping, parking lot, pedestrian ways, building, curbing and other elements as shown on the exhibits or contained in the conditions be completed by October 15, 1987. 27. That the site development plans identified in Condition No. 1 are hereby modified so that the site shall be developed, used and maintained as shown on Exhibits A-1, Site Layout Plan Revised 5/30/86; Exhibit 8-1, Grading and Drainage Plan; Exhibit C-1, Landscape Plan; Exhibit D-1, Parking Circulation Plan; Exhibit E-1, Utility Plan; and Exhibit F-1, Elevations (exhibits are filed with Case No. 86 -5 -SP), subject to the following conditions: a. That Condition No. 2 above is hereby modified to read, "There shall be no outside storage of goods or material." b. That Condition No. 3 above is hereby deleted. c. That Condition No. 4 above is hereby modified to read, "That the east side of the building and adjacent property shall be landscaped and designed to prohibit automobiles, trucks and other vehicles from ingress and/or egress between the truck loading area and the parking area to the south." d. That the TBA referred to in Condition No. 9 is hereby deleted. e. That the words, "except as allowed in the Garden Center" be deleted from Condition No. 12. f. All work including landscaping, parking lot, pedestrian ways, building, curbing and other elements as shown on the exhibits or contained in the conditions be completed by October 15, 1987.
