HomeMy WebLinkAbout86-59 - ADMIN Resolution - City Council - 1986/05/05RESOLUTION NO. 86-5Q RESOLUTION GIVING APPROVAL FOR FINAL PLAT OF DABCO ADDITION BE IT RESOLVED BY the City Council of St. Louis Park: Findings 1. Dan -Bar Homes, Inc., owners and subdividers of the land proposed to be platted as DABCO Addition have submitted an application for approval of final plat of said subdivision in the manner required for platting of land under the St. Louis Park Ordinance Code, and all proceedings have been duly had thereunder. 2. The proposed final plat has been found to be in all respects consistent with the City Plan and the regulations and requirements of the laws of the State of Minnesota and the ordinances of the City of St. Louis Park. 3. The proposed plat is situated upon the following described lands in Hennepin County, Minnesota, to -wit: DABCO Addition being Lot 1, Block 1, "Linner's Addition" and that part of Lot 3, Block 1, "Linner's Addition, except that part thereof lying Easterly of the following described line: Beginning at a point on the South line of said Lot 3, distant 17.64 feet West along said South line from the Southeast corner of said Lot 3; thence on an assumed bearing of North parallel with the East line of said Lot 3 a distance of 33.50 feet; thence North 27 degrees 16 minutes 11 seconds East 38.50 feet to said East line and there terminating located at the Southwest corner of the intersection of 13 1/2 Street and Rhode Island Avenue. Conclusion 1. The proposed final plat of DABCO Addition is hereby approved and accepted by the City as being in accord and conformity with all ordinances, City plans and regulations of the City of St. Louis Park and the laws of the State of Minnesota, subject to the following conditions: (a) That a covenant prepared by the owners and subdividers and subject to approval by the City shall state that the above-described real estate is and shall always be subject to the restrictions of City of St. Louis Park Special (Conditional Use) Permit granted by Resolution No. 86-20 adopted by the City Council on February 3, 1986, and that no building permit shall be issued on any part of the foregoing described real estate that does not conform to the terms of the Special (Conditional Use) Permit as it was issued, whether or not said Special (Conditional Use) Permit subsequently expires by its own terms. The terms of this covenants shall be altered or terminated only with the consent of the City of St. Louis Park by City Council resolution specifically referring to said real estate, and with the consent of the owners all of the said estate. provided, however, that this approval is made subject to Certification by the City Clerk 2. The City Clerk is hereby directed to supply two certified copies of this Resolution to the above-named owner and subdivider, who is the applicant herein. 3. The Mayor and City Manager are hereby authorized to execute all contracts required herein, and the City Clerk is hereby directed to execute the certificate of approval on behalf of the City Council upon the said plat when all of the conditions set forth in Paragraph No. 1 above and Section 14-303(3Xe) of the St. Louis Park Ordinance Code have been fulfilled. 4. Such execution of the certificate upon said plat by the City Clerk, as required under Section 14-303(3Xe), shall be conclusive showing of proper compliance therewith by the subdivider and City officials charged with duties above-described and shall entitle such plat to be placed on record forthwith without further formality.
